<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO
<br />~40-$5 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT
<br />BEING KNOWN AS "CAMBRIDGE COURT" AND DESIGNATED AS GHP-84-15.

<br /> WHEREAS, Benjamin J. Levy, General Partner of Peachtree Associates, has made application
<br />pursuant to §40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the granting
<br />and approval of a group housing project consisting of n~nety-two (92) condominium units on
<br />6.4 acres located in the northwest corner of Towne Point and Twin Pines Roads intersection; a
<br />
<br /> WHEREAS, the application has been determined by the Planning Commissmon to have met the
<br />requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuar
<br />to ~40-55 grants-~nly an exemption from certain requirements for residences as stated in said
<br />section and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicabl(
<br />local, state or federal law or regulation: and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of a ninety-two (92) unit condominium developmenl
<br />known as "Cambridge Court" to be constructed on a 6.4 acre parcel located at the northwest
<br />corner of Towne Point and Twin Pines Roads intersection, and designated as ~HP-84-15, and mor(
<br />specifically described in correspondence dated August 8, 1984 from Joseph Preziotti, Jr., and
<br />supplemented by correspondence from Joseph Preziotti, Jr. dated August 20, 1984, and from
<br />Benjamin J. Levy dated August 24, 1984, and shown on plans filed with the appropriate official
<br />of ~he City of Portsmouth, Virginia, such being made a part hereof, is hereby granted approval
<br />subject to the following term and condition:

<br /> 1. Ail necessary permits must be secured and an agreement acceptable to the City of
<br />Portsmouth must be entered into for the provision of adequate sewer service.

<br />adopted, and by the following vote:

<br />"A RESOLUTION GRANTING A USE PERMIT TO MILTON L. HILL, GLADYS B. HILL, AND
<br />BARBARA'LEE TO OPERATE A CHILD CARE CENTER AT 1500 SUMMIT~ AVENUE.
<br />
<br /> WHEREAS, Milton L. Hill, Gladys B. Hill, and Barbara Lee, have made application pursuant
<br />to ~40-78 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a
<br />use permit to operate a child care center; and
<br />
<br /> WHEREAS, the applicant and .the Planning Director have done all things required to be
<br />done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting oE a use permit for the
<br />operation of a child care center as defined in ~40-31 of said Code.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) ~ill not adversely affect the health and safety of persons residing or working
<br />the neighborhood of the proposed use;
<br />
<br />(b) Will not be detrimental to the public use or injurious to the property or im-
