29: <br /> <br />November 20, 1984 <br /> <br />84-412- Use permit and group housing project applications: <br /> <br />(b) "A RESOLUTION GRANTING A USE PERMIT TO LIZZIE AND CLAYTON JACKSON TO <br /> OPERATE AN AUTOMOTIVE SERVICE STATION AT 2921 PORTSMOUTH BOULEVARD. <br /> <br /> WHEREAS, Lizzie and Clayton Jackson have made application pursuant to ~40-70 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit <br />as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be dons <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has made a recommendation regarding the granting of saL <br />use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for~which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements of the neighborhood; and - <br /> <br />(c~ Will be in accordance with the purposes of the Zoning ChaPter of the City Code. <br /> <br /> 2.- Lizzie and Clayton Jackson are hereby granted a use permit pursuant to §40-70 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, to operate an automotive service stati <br />as defined in ¢40-31 of said Code at 2921 Portsmouth Boulevard, such property being more parti <br />cularly described as follows: <br /> <br />UP-84-15 <br /> <br /> BEGINNING at the southeast corner of Portsmouth Boulevard and Royal Street; '~ <br />thence south along the east side of Royal Street 110', more or less; thence <br />east 120'; thence north ll0', more or less to the south right-of-way of Portsmouth <br />Boulevard; thence west along said right-of-way to Royal Street, the Point of <br />Origin. <br /> <br />3. This use permit is approved subject to the following condition: <br /> <br /> (a) A six (6') privacy fence shall be erected along the rear property line prior <br />to expansion of the existing automobile service station by the construction of an additional <br />inspection bay." <br /> <br />(d) <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />§40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br />BEING LOCATED BETWEEN VICTORY BOULEVARD AND DALGREN AVENUE AND DESIGNATED <br />GHP-84-16. <br /> <br /> WHEREAS, Joseph McDaniel has made application pursuant to §40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing project <br />consisting of seventy-two (72) rental apartment units to be located between Victory Boulevard <br />and Dalgren Avenue; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of [40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted <br />therewith and has recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuar <br />to ~40-55 grants only an exemption from certain requirements for residences as stated in said <br />section, and does not constitute a waiver Of any other requirement embodied in the subdivisior <br />ordinance, zoning ordinance, code of the City of Portsmouth, Virginia, or any other applicable <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or any other required permit will <br />issued only upon compliance with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain ~roup housing project consisting of seventy-two (72) rental apartment units to be <br />constructed on an area of approximately 5.07 acres located between Victory Boulevard and <br />Dalgren Avenue and designated as GHP-84-16, and more specifically described in correspondence <br />from Joseph Preziotti, Jr., dated September 10, 1984, and shown on plans designated "Cradock <br />Colonials" and filed with the appropriate officials of the City of Portsmouth, Virginia, such <br />being made a part hereof, is hereby granted approval subject to the following terms and con- <br />ditions: <br /> <br />1. Fencing with intermittent vegetation shall be provided along Victory Boulevard. <br /> <br /> <br />
