369 <br /> <br />Maych lZ, 1985 <br /> <br />"A RESDLUTION AUTHORIZING tHE CITY MANAGER TO CONVEY CERTAIN SUBAQUEOUS REAL <br />PROPERTY TO THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY DF PORTSMOUTH. <br /> <br /> WHEREAS, the Commonwealth of Virginia has conveyed to the City of Portsmouth certain rea] <br />property located in the City of Portsmouth in the Western Branch of the Elizabeth River; and <br /> <br /> WHEREAS, said property is suitable for industrial development in the City as directed by <br />the Industrial Development Authority of the City of Portsmouth; and <br /> <br /> WHEREAS, ~2.09 (c) of the Charter of the City of Portsmouth provides that property <br />may be conveyed to the Commonwealth of Virginia or a political subdivision thereof without <br />advertisement and receipt of bids; and <br /> <br /> WHEREAS, the Industrial Development Authority of the City of Portsmouth is a political <br />subdivision of the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by <br />that the City Manager be, and he hereby <br />Authority of the City of Portsmouth the <br /> <br />the Council of the City of Portsmouth, Virginia, <br /> is, authorized to convey to the Industrial Development <br /> following described property, to-wit: <br /> <br /> A certain lot, pzece or parcel of land, together with all rinarian rights <br />incident thereto, lying, situate and being in the Western Branch of the Elizabeth <br />River in the City of Portsmouth, Virginia, shown on a certain plat recorded in <br />the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in <br />Map Book 7, at page 6, lying between the mean low water mark and the Harbour <br />Line as shown on said plat, said property being more particularly described with <br />reference to said plat as follows: <br /> <br /> BEGINNING at a point at the intersection of the eastern line of the right-of-way <br />of Chautauqua Avenue and the northern line of the right-of-way of Bayview Boulevard <br />as shown on the aforesaid plat; and from said point running along the northern line <br />of said right-of~way of Bayview Boulevard, S. 89° 12' W., a distance of 70.19 feet <br />to a point; thence running N. 4° 58' W., to the mean low water mark of the Western <br />Branch of the Elizabeth River (the "noint of beginning"), thence running from said <br />point of beginning N. do 58' W. to a pomnt in the Western Branch of the Elizabeth <br />River designated "Harbour Line" on the aforesaid plat; thence running along said <br />Harbour Line N. 79~ 47' OS" E., a distance of ~66.51 feet to a point in the <br />Norfolk and Portsmouth Belt Line Railroad right-of-way; thence running S. ~o 58' E. <br />to a point at the mean low water mark of the said Western Branch of the Elizabeth <br />River; thence running westerly along said mean low water mark to the noint of <br />beginning. <br /> <br /> BE I~ FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to sign suc <br />deeds and other documents as may be necessary to complete this transaction." <br /> <br />Ayes: Beamer, CorFrew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-73 Letter from ~the City Manager recommending adoption of a motion to transfer $4,000 <br />from the Grants Contingency Account to support a Virginia Commission for the Arts grant award <br />for a sculpture exhibit. <br /> <br /> "I have recently been notified by Ms. Peggy J. Baggett, Executive Director of the Virgin] <br />Commission for the Arts, of a $4,000 grant award for a sculpture exhibit. <br /> <br /> Artists thr~ughout Virginia will be seIected to present contemporary sculptures and <br />installations as a symbol of Portsmouth's cultural thrust in the downtown revitalization <br />efforts. The exhibits will be displayed in the 1846 Courthouse gallery and the outdoor Court- <br />yard. The exhibits will be interpreted through a series of lectures which will be held on <br />Friday evenings during the exhibition period. Artists will convey to the audience their <br />visions and methods of expression. A ~atalogue of the exhibition will also be published. <br /> <br /> The award of $4,000 from the Virginia Commission for the Arts represents 50% of the <br />project costs. The recuired local match of 50% will be contributed through staff time and <br />volunteer services totaling $2,930, and $1,070 is anticipated income fr~m the sales of the <br />exhibition's catalogues. <br /> <br /> This exhibition represents a major contribution from the Commission for the Arts and the <br />Department of Museums in making quality art activities available to the citiznns of Virginia. <br />I recommend acceptance of the grant award and the transfer of $4,000 from the Grants Contin- <br />gency Account to support the project." <br /> <br /> Motion of Mr. Gray and seaonded by Mr. Beamer, that authorization be granted to transfer <br />$4,000 from the Grants Contigency Account, as requested, and was adopted by unanimous vote. <br /> <br /> 85-74 Letter from the City Manager recommending adoption of a motion to refund $423.68 <br />(without interest) to David A. Cohen for 1984 Personal Property Tax. <br /> <br /> "The Commissioner of the Revenue is requesting a refund of 1984 Personal Property taxes <br />to David A. Cohen, 4886 Sterling Point Circle, Portsmouth, Vireinia 34803 <br /> <br /> Mr. Cohen is military and a resident of another state, therefore, is exemot from Personal <br />Property naxes in Virginia. A refund of $423.68 (without interest) is reeuested. <br /> <br /> <br />
