May 14, 1985 WHEREAS, the applicant and the Planning in connection with said application, and the permit be granted. Director have done all things required to be done Planning Commission has recommended that said use NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. that the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or in[urious to ~he property or improve ments in the neighborhood: and (c) Will be in accord with~the purposes of the zoning chapter of the City Code. 2. Maryview Hospital Corporation is hereby granted an amendment to the use oermit adopte. by the Council of the City of Portsmouth, Virginia, at a meeting held April 23, 1974 in order to permit the operation of a parking lot to meet the parking requirements for Maryview Hospital and a professional office building proposed for the northeast corner of High Street and Willett Drive on the property described as follows: UP-85-4 BEGINNING at the s6~t~ast co~n~ of West Road and Willett Drive; thence easterly along the south right-of-way of West Road 298.01' to a point; thence southerly 329.90'; thence westerly 297' to the east right-of-way of Willett Drive; thence northerly along said right-of-way 310.65' to West Road, the pomnt of origin. 3. The following conditions are prescribed for this amendment to the use permit: (a) Additional trees and intermittent screening be planted along the perimeter of the parking lot that borders Willett Drive and West Road." Ayes: Beamer, Cor~re~,Gray Nays: Lucas Abstaining: Webb, Whitlow, Holley (c) On motion of Mr. Beamer and seconded by Mr. ~Corprew, the following resolution a~proved on firat reading at the meeting of April 23, 1985, was adopted on fimal reading, by the following vote: and 'A RESOLUTION GRANTING A USE PERMIT TO MARYVIEW HOSPITAL CORPORATION FOR PROPERTY WES7 OF THE ABANDONEI RAILROAD RIGHT-OF-WAY LYING BETWEEN PRINCETON PLACE AND ~ESTERN BRANCH BOULEVARD ~TAX MAP 354, PARCEL 1 AND TAX MAP 355, PARCELS 5 AND 9), WHEREAS, Maryview Hospital Corporation has made application for an amendment to a use permit granted for the operation of a hospital and related facilities on High Street at Willett Drive by the Council of the City of Portsmouth, ~irginia, on April 23, 1974; and WHEREAS, Section 40-48 of the Code of the City of Portsmouth, Virginia, 1973, provides that parking space required for any use located in any residential district may, by use permit incorporate land not contiguous with the principal use when included on a site plan referenced mn a City Council resolution granting such conditional use permit; and WHEREAS, the applicant and the Planning in connection with said application, and the amendment to the use permit be granted. Maryvi~w Hospital Corporation is hereby granted an amendment to the use permit granted for the operation of a hospital and related ~acilities on High Street at Willett Drive on April 23, 1974 and is permitted to operate a parking lot pursuant to Section 40-48 of the Code of the City of Pertsmouth, Virginia, 1973, on the property described as follows: UP-85-5 BEGINNING an the northwest corner of Western Branch Boulevard and Rodman Avenue; thence westerly along the north right-of-way Western Branch Boulevard 287', more or less, to a pomnt; thence northerly 130'; thence westerly 20', more or less; thence northerly 120' to the south right-of-way of Princeton Place: thence easterly along said right-of-way 164.7' to a point; thence southeasterly 110'; thence southeasterly 35', more or less; thence easterly 65' to the west right-of-way 125', more or less, to the Point of Origin.
