<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws, or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain Group Housing Project consisting of ninety-seven (97) townhouse-style apartments
<br />known as "Pepperwood Ill" to be constructed on 6.96 acres located between Pepperwood Court and
<br />the proposed Western Freeway and designated as GHP 85-8 and more specifically described in
<br />correspondence from the Bickford Company dated March ~ 1985 as shown on plans designated
<br />'Pepper~ood, Sec. 3" filed witk the appropriate officiJls of the City of Portsmouth, Virginia,

<br /> (1) A landscapin§ plan indicating more detail in screening, buffer provisions adjacent t
<br />the single family homes and indicating location of internal sidewalks must be submitted for
<br />review and approval to the Planning Department.

<br /> (2) An access easement to the existing single family residence must be provided to the
<br />public street.

<br /> (3) Occupancy permmts and any other required ~ermit will be issued at

<br />the northeast corner of Hartford Street and Douglas kvenue in Port Norfolk; and

<br /> WHEREAS, the application filed by Kirk Berkley, Architect, has been determined by the
<br />Planning Commission to have met the requirements of Section 40-55; and
<br /> WHEREAS, the Planning Commission has reviewed s~ch application and site plans submitted
<br />therewith and has recommended approval of said application; and

<br /> WHEREAS, the developer has been informed that approval of a Group Housing Project
<br />pursuant to Section 40-55 grants only an exemption from certain requirements for residences
<br />as stated in said section and does not constitute a ~zaiver of any other requirement embodied
<br />in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or
<br />any other applicable local, state, or federal law or regulation; and
