<br /> WHEREAS, The Garden of Prayer Temple, and Bishop L. E. Willis, contract owners, has made
<br />application pursuant to Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973,
<br />as amended, for the granting and approval of a Group Housing Project consisting of a four (4)
<br />unit apartment building on the north side of Soutk Street between Washington and Green Streets
<br />and
<br />
<br /> WHEREAS, the application

<br />filed by Gerald F. Martin, A.I.A., has been determined by the
<br />the requirements of Section 40-55 of the Code of the City of
<br />amended; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted
<br /> therewith, and has recommended a conditional approvaI of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a Group Housing Proj,ect pursuanl
<br /> to Seztion 40-SS grants only an exemption from certain requirements for residences as stated
<br /> in said section and does not constitute a waiver of ~ny other requirement embodied in the
<br /> Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any othe
<br /> applicable local, state or federal laws or regulations; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws, or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain Group Housing Project consisting of a four (41 unit apartment building located on
<br />the north side of South Street between Washington and Green Streets and designated as GHP-SS-6
<br />and more specifizally described in correspondence fr~m Gerald F. Martin, A.I.A., and shown on
<br />plans designated "Garden of Prayer Facility" filed w~th th~ appropriate officials of the City
<br />of Portsmouth, Virginia, such correspondence and pla~s being made a part hereof, is hereby
<br />granted approval subject to the following terms and zonditions:

<br /> (1) Final review and approval must be received from the Downtown D-1 Design Committee
<br />prior to issuance of building permits."
<br />
<br /> (i) "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO
<br /> SECTION 40-55 OF THE CODE OF THE CITY OF pORTSMOUTH, VIRGINIA, 1973, AS
<br /> ~MENDED, SAID PROJECT BEING LOCATED ON TH~ EAST SIDE OF GREEN STREET
<br /> BETWEEN NORTH AND EFFINGH~ STREETS.

<br /> WHEREAS, P. H. Boyette, Jr. & Company, Inc., contract owner, has made application pursuan~
<br />to S~ction 40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the granting and
<br />approval of a Group Housing Project consisting of ei hteen (18) condominiums on a 017276 acre

<br />parcel located on the east side of Green Street betw

<br /> WHEREAS, the application has been determined by
<br />requirements of Section 40-55 of the Code of the Cit
