<br /> 85-171 Letter from the City Manager recommending adoption of an ordinance to amend the
<br />Code of the City of Portsmouth, Virginia, 1973, by:
<br />
<br />(a) amending Section 21-97, pertaining to noise enumeration of prohibited
<br /> acts.
<br />(b) amending Section 21-20, 21-21, 21-58(a), 21-41, and 21-85(a) of the Code
<br /> of the City of Portsmouth, Virginia, 1973, pertaining to miscellhneous
<br /> offenses as mandated by the State Code.
<br />(c) amending Section 20-239 pertaining to the removal of hazardous or illegally
<br /> parked vehicles.
<br />(d) amending Section 6-17(e) thereof pertaining to buildings.
<br />
<br /> "The City Attorney is in the process of his annual review of legislative actions, taken b
<br />the General Assembly of Virginia which mandates chan~es in the City Code. As a result of this
<br />review, the City Attorney recommends that the following amendments to the City Code be approve
<br />
<br /> 1. The penalty of doing electrical, plumbing or mechanical work without a
<br />of competency has been redefined as a Class 3 misdemeanor (maximum fine of $500)
<br />the previously stated maximum fine of $1,000. Section 6-17'needs to be amended
<br />paragraph (e) designating the new penalty.

<br /> 2. Vehicles impounded by the Police Department as hazardous or illegally parked vehicles
<br />may be sold by the City if not claimed within a specified period of time. The General Assemb]
<br />has reduced the holding period from forty-five (45) days to thirty (30) days and, therefore,
<br />Section 20-239 should be changed to reflect the shorter holding period.
<br />
<br /> 3. Section 21-97 of the City Code enumerates certain acts as being violating of the
<br />noise ordinance (Section 21-96), and the General Assembly has included as a noise offense
<br />the operation of a motorcycle which is not equipped with a muffler if such noise'.is hazardous
<br />to the health and well-being of the citizenry. An additional subparagraph to Section 21-9-
<br />will list same as an enumerated prohibited act.

<br /> 4. Chapter 21 of the City Code pertains to miscellaneous offenses, and recent action by
<br />the General Assembly requires amendments to those sections dealing with analysis and breath
<br />and use of chemicgt tests to determine alcohol content of blood (Sections 21-20 and 21-21),
<br />concealed weapons (Section 21-38), possession of dangerous weapons (Section 21-41), and unlaw-
<br />ful acts relating to juveniles (Section 21-83).

<br /> I concur in the City Attorney's recommendation that the enclosed ordinances be adopted
<br />to amend the City Code to reflect changes in the State law."
