June 11, 1985 <br /> <br />"A RESOLUTION REQUESTING THE DESIGNATION OF A PORTION OF CITY PARK ROAD AS A SCENIC <br />HIGHWAY OR BYWAY IN CONNECTION WITH RECREATIONAL USE. <br /> <br /> WHEREAS, the City of Portsmouth has obtained a commitment from the Department of High- <br />ways 8 Transportation for funding for the reconstruction of a pertion of City Park Road; and <br /> <br /> WHEREAS, Section 33.1-223, Code of Virgmnia, provides that after construction such road <br />shall be designated as a scenic highway or byway in connection with recreational use: and <br /> <br /> WHEREAS, a public hearing has been conducted by the Planning Commission of the City of <br />Portsmouth and by the Council of the City of Portsmouth concerning the issue of designation of <br />a portion of City Park Road as a scenic highway or byway in connection with recreation use. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />request is hereby made of the Virginia Department of Highways ~ Transportation for designation <br />of the hereinafter described portion of City Park Road as a scenic highway or byway mn connec- <br />tion with recreational use as prcvided by law: <br /> <br />City Park Road <br /> <br /> That portion of City Park Road extending north from Park Manor Driue for a <br />distance of 0.48 miles and being designated as Project 9999-124-104 by the Virginia <br />Department of Highways 8 Transpcrtatien." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br />UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br /> On motion of Mrs. Webb and seconded by b{rs. Lucas, the following mtems approved on first <br />reading at the Public Hearing and regular meeting of May 28, 1985, were adopted on final read- <br />lng by the following vote: <br /> <br />85-143 Use permit and group housing applications: <br /> <br />(e) "A RESOLUTION CRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY SERVICES <br /> BOARD TO OPERATE A GROUP HOME FOR MENTALLY RETARDED ADULTS AT ~ ELM <br /> AVENUE. <br /> <br /> WHEREAS, Francis J. and Peggy Nadeau has made application on behalf of the Portsmouth <br />Community Services Board pursuant to Section 40-78 (b) of the Code of the City of Portsmouth, <br />Virginia, as amended, for the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application: and <br /> <br />WHEREAS, the Planning Commission has recommended the granting oE said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the healthcand safety of persons resid&~gs-or working in the <br />neighborhood of the proposed use; <br /> <br /> (bl Will not be detrimental ro the public use or in-urious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. The Portsmouth Community Services Board is hereby granted <br />Section 40-78 (b) of the Code of the City of Portsmouth, Virginia, <br />for eight (8) mentally retarded adults at 242 Elm Avenue (UP-85-8). <br /> <br />use permit pursuant to <br />operate a group residenc <br /> <br />3. The following conditions are prescribed for this use permit: <br /> <br /> (a) Not more than~¢ight (8) clients of the Portsmouth Community Services Board <br />may be residents at any one time. <br /> <br />(b) All fire, building and health codes must be met prior to occupancy. <br /> <br /> (c) The applicant shall comply with all applicable codes, ordinances, policies <br />and regulations of federal, state and local governments. <br /> <br /> (d) The use permit is issued ro the Executive Director of the Portsmouth Community <br />Services Board for 242 Elm Avenue and is not transferable ro any other person, entity, <br />corporation, or location." <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID <br />PROJECT BEING A FOUR (4) UNIT RENTAL APARTMENT BUILDING IN THE NORTHEAST <br />CORNER OF HANSEN AVENUE AND WALL STREET AND DESIGNATED AS GHP-85-13. <br /> <br /> <br />
