July 9, 1985 <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />provements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br /> <br /> residing or working <br /> <br /> to the property or im- <br />Chapter of the City Code. <br /> <br /> 2. Medical Facilities of American, Inc. is hereby granted a use permit pursuant to <br />Section 40-75 (b) of the City Code to operate a nursing home on a 2.9 acre parcel on the west <br />side of Towne Point Road lying south of Bickford Parkway and approximately 650 feet north of <br />Churchland Boulevard which site is more particularly described as follows: <br /> <br />UP-85-13 <br /> <br /> BEGINNING on the west right-of-way of Tejo Lane 220 feet, more or less <br />south from its intersection with Kenny Lane: ~hence westerly 418.18 feet; <br />thence southerly 214.40 feet; thence southeasterly 167.35 feet: thence easter%y <br />223.04 feet; thence northeasterly 29.?4 feet; thence northerly 343.25 feet to <br />The Point of Origin. <br /> <br />3. The use permit is approved subject to the following conditions: <br /> <br /> (a) All applicable state and local licenses must be obtained prior ro commencement <br />of operation. <br /> <br /> (b) Ail building, fire and health code requirements must be satisfied prior to <br />commencemnt of operation. <br /> <br />(c) only those signs permitted in the residential R-75 District will be allowed. <br /> <br /> (d) Additi'onal landscaping shall be provided around the perimeter of the building t <br />soften the visual affect. <br /> <br />(e) No more than 100 patients may be cared for at this facility au any one time. <br /> <br />(f) Tejo Lane shall be extended to Churchland Boulevard. <br /> <br /> (g) This use permit is issued to Medical Facilities of America, Inc. for the <br />property described herein and is not transferable to any other person, entity, or location." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, H61ley <br />Nays: None <br /> <br />Item Removed from the Consent Agenda was presented: <br /> <br />85-177 - Use permit application. <br /> <br /> (d) On Motion of Mr. Beamer and seconded by Mrs. Webb the following resolution approved <br />on fira~ reading at the meeting of July 9, 1985, was amended to waive the 30 days period, as <br />requested, and was adopted by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO JOHNNY OWENS AND RICHARD D. KNAUFT <br />FOR THE CONVERSION OF AN EXISTING SINGLE-FAMILY DWELLING TO A DUPLEX <br />RESIDENCE AT 626 BROAD STREET (~P-SSztl). <br /> <br /> WHEREAS, Johnny Owens and Richard D. Knauft, has made application pursuant <br />40-102 (B) for a use permit to convert an existing single-family residence to a <br />at 626 Bro~d Street which is located in the Port Norfolk Historic District; and <br /> <br />to Section <br />duplex residen <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things r~quired to be done <br />in connection with said application; and <br /> <br /> WHEREAS, <br />conditions for <br />structure. <br /> <br />the Planning Commission nas recommended the granting of a use permit with <br />the conversion of an existing single-family dwelling zo a duplex residential <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City o~ Portsmouth, ¥irg~n~a: <br /> <br />1.
