<br /> 2. Johnny Owens and Richard D. Knauft are hereby granted a use permit pursuant to
<br />Section 40-102 (B) to convert an existing single-family residence to a duplex residential
<br />structure at 626 Bmmad Street, such conversion to be in compliance with the regulations
<br />applicable to the Port Norfolk Historical Residential Sub-District as provided for in the
<br />Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such
<br />approval being granted subject to the following terms and conditions:

<br />GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO
<br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID
<br />A 10 UNIT CONDOMINIUM LOCATED ON THE WEST SIDE OF WEST NORFOLK
<br />ITS INTERSECTION WITH VAN BUREN STREET AND DESIGNATED AS

<br /> WHEREAS, Chris Boyette and Uohn M. Staylor, has made application pursuant to Section 40-
<br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a gro~
<br />housing project consisting of ten tI0) unit condominium on a 0.9125 acre parcel located on th(
<br />west side of West Norfolk Road north of its intersection with Van Buren Street; and
<br />
<br /> WHEREAS, the applicant has been determined by the Planning Commission to have met the
<br />requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as
<br />amended; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed said application and site plans submitted
<br />therewith and has recommended a conditional approval ~f said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project
<br />pusuant to Section 40-55 grants only an exemption from certain requirements for residences
<br />as stated in said section and does not constitute a waiver of any other requirement embodied
<br />in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or
<br />any other applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit
<br />will be mssued only upon compliance with the ordinances, law, or ~egulations applicable
<br />thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of ten (101 condominium units on a 0.9125 acre
<br />parcel located on the west side on West Norfolk Road and north of its intersection with
<br />Van Buren Street and designated at GHP-85-18 and more specifically described in correspondenc(
<br />from Gerald F. Martin, Architect, dated March 5, 1985 as shown on plans designated "Pronosed
<br />Group Housing Prpje~t. For Chris Boyette", filed wit~ the appropriate officials of the C%ty
<br />of Portsmouth, Virginia, such plans being made a pa~t hereof, is hereby granted approval
<br />subject to the following terms and conditions:
<br /> 1. The landscaping plan be revised to ~i{~~ landscaping of rear yard area to
<br />provide visual relief to the rear elevation and moderate privacy.
<br />
<br /> 2. A standard site improvement plan be submitted to the Department of Engineering and
<br />Technical Services for review and approval.
