,July 9. 1985 <br /> <br /> WHEREAS, the Planning Commission has reviewed suzh application and site plans submitted <br />therewith and has recommended condtional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project F <br />to Section 40-55 grants only an exemption from certain requirements for residences as stated <br />said section and does not constitute a waiver of any other requirement embodied in the Sub- <br />division Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other <br />applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or any other required permit will <br />be issued only upon compliance with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain group housing project consisting of five (51 townhouse-styled condominiums to be <br />constructed on a 0.4641 acre parcel located adjacent to Westmoreland Townhouses off Clover <br />Hill Drive and designated as GHP-S8-17 and more specifically described in correspondence fro2 <br />C. Raeford Eure dated March 6, 1985 as shown on plans designated "Westmoreland Condominiums" <br />filed with the appropriate officials of the City of Portsmouth, Virginia, such being made a <br />part hereof, is hereby granted approval subject to the following terms and conditions: <br /> <br />1. Front and side elevations must be constructed of brick veneer. <br /> <br /> 2. Prior to issuance of building permits, the landscape plan must be revised to shown <br />vegetatzve screening of parking spaces and either privacy fence enclosures aroung patios or <br />suitable vegetative screening to lend privacy in the rear of the structure. <br /> <br /> 3. A standard site ~mprovement plan including adequate turnaround space for emergency <br />vehicles must be submitted to the Department of Engineering and Technical Services for review <br />and approval. <br /> <br />(c) <br /> <br />"A RESOLUTION GRANTING A USE PE~IT TO KENNETH D. SLAUGHTER, CHRISTOPHER <br />K. CROCKETT AND NICHOLAS F. MARTINO, FOR THE CONVERSON OF AN EXISTING <br />DUPLEX TO A TRIPLEX AT 200 FLORIDA AVENUE (UP-SS-10). <br /> <br /> WHEREAS, Kenneth D. Slaughter, Christopher K. Crockett and Nicholas F. Martino, has made <br />application pursuant to Section 40-102 (B) for a use permit to convert an existing duplex <br />residence to a triplex az 200 Florida Avenue which is located in the Port Norfolk Historic <br />District; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all thins required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of a use permit with con- <br />ditions for the conversion of the existing duplex residence to a triplex residence. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Counci2 of the City of Portsmouth, Virginia: <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes o~ the Zoning Chapter of the City Code. <br /> <br /> 2. Kenneth D. Slaughter, Christopher K. Crockett and Nicholas F. Martino are hereby <br />granted a use permit pursuant to Section 40-102 (B) to convert an existing duplex residence <br />to a triplex residence at 200 Florida Avenue, such conversion to be in compliance with the <br />regulations applicable to the Port Norfolk Historic Residential Subdistrict as provided for <br />in the Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such <br />approval being granted subject to the following ter~s and conditions: <br /> (a) The applicant shall comply with the a~proval from the Commission of Arc <br />Review for the on-site parking. <br /> <br /> (b) The applicant shall co$1i!ywith all applicable codes, ordinances, policies and <br />regulations of the City of Portsmouth and shall obtain all necessary licenses and permits." <br /> <br />"A RESOLUTION GRANTING A USE PERMIT <br />INC.
