<br /> WHEREAS, the developer has been informed that the approval of a group housing project
<br />pursuant to Section 40-55 grants only an exemption from certain requirements for residences an
<br />stated ~n said section and does not constitute a waiver of any other requirement embodied in
<br />the subdivision ordinance, Code of the City of Portsmouth, Virginia, or any other applicable
<br />local, state or federal laws or regulations; and ~
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws and regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESCLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing Froject designated as GHP-S5-19 and more specifically described in
<br />correspondence from Michael Smith, General Partner, Master Development Corporation, to the
<br />Director of Planning dated April 10, 1985 and further eIaborated upon in correspondence from
<br />Alan Jenson, A.I.A. and President of Master Development Corporation to Patrick J. Coffield,
<br />dated June 25, 1985, to Danny E. Cruce, dated July 2, 1985, and to George L. Hanbury, dated
<br />July 3, 1985, and more specifically shown on plans filed with the appropriate officials of
<br />the City of Portsmouth, Virginia, such plans and correspondence being made a part hereof, is
<br />hereby granted approval subject to the following conditions:
<br />
<br /> 1. Final approval from the Downtown D-1 Design Committee must be granted prior to
<br />issuance of building permits.
<br />
<br /> 2. A standard site improvement plan must be submitted to the Department of Engineering
<br />and Technical Services for review and approval.
<br />
<br />3. The plans noted above shall be revised to provide for the following:
<br />
<br />(a) Add fire places to each unit;
<br />(b) Add decks or proches to each unit;
<br />(c) Add exposed bricks for the chimneys on the
<br /> ends of the buildings;
<br />id) Add security fencing to enclose the property and
<br /> surround the parking area with apFropriate gates;
<br />[e) Provide optional jacuzzis mn all bath rooms.
<br />
<br /> 4. That the additions noted in paragraph 3 above will increase the anticipated selling
<br />price of the units into the seventy thousand dollar plus ($70,000+) price range.

<br /> Development Corporation, for 54 units on property on the north
<br /> side of Bart Street between Effingham and Washington Streets.

<br /> Jim Wayland, 454 Florida Avenue, representing Metro Development Corporation, requested
<br />approval on final vote.
<br />
<br /> James W. Jones, Attorney, 3800 Poplar Hill Road, Chesapeake, VA, representing Metro
<br />Development Corporation, spoke concerning the condominium law in the Virginia legislation,
<br />and asked that the clause "will not be retained by the developer for rental purposes" in the
<br />resolution be deleted. After discussion with Metro Development, Mr. Jones withdrew objection
<br />to the clause and indicated that his client accepted the conditions.
<br />
<br /> Motion of Mrs. Lucas and seconded by Mrs. Webb, that GHP 85-24 be moved down on the
<br />agenda for counsel of the developer and the City Attorney to have consultation on the matter.
<br />
<br />Mrs. Lucas and Mrs. Webb withdrew the motion.

<br />Whitlow and seconded by Mrs. Webb, the following resolution approved on
<br />Public Hearing of July 9, 1985, was adopted on final reading, and by the
<br />
<br />"A RESCLUTION GRANTING APPROVAL OF A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CON-
<br />SISTING OF FIFTY FOUR (54) CONDOMINIUM UNITS ON 1.56 ACRES NORTH OF BART STREET
<br />BETWEEN WASHINGTON AND EFFINGHAM STREETS AND DESIGNATED AS GHP-85-24.
<br />
<br /> WHEREAS, Metro Development Corporation, has made application pursuant to Section 40-55
<br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting and apporval of a grou
<br />housing project consiting of fifty four (54) condominium units on 1.56 acres north of Bart
<br />Street between Washington and Effingham Streets; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission zo have met the
<br />requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amende
<br />and
<br />
<br /> WHEREAS, the Planning Commission has reviewed s&id application and site plans submitted
<br />therewith and has recommended a conditional approval of said application: and
