<br />subdivision ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any
<br />other applicable, local, state, or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit wilI
<br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of fifty four (54) condominiums in six (6)
<br />structures on 1.56 acres north of Bart Street between Washington and Effingham Streets and
<br />designated as GHP-S5-24, and more specifically described in correspondence from Michael %.
<br />Rowe, President, Metro Development Corporation, dated May 8, 1985, with enzlosures as shown
<br />on plans designated "Effingham Green" filed with th~ appropriate officials of the City of
<br />Portsmouth, Virginia, such being made a part hereof, is hereby granted approval subject to
<br />the following terms and conditions:

<br /> 1. A standard site improvement plan must
<br />and Technical Services for review and approval
<br />the terminus of Green Street.

<br />be submitted to the Department of Engineering
<br />and must include public turn around space at
<br />
<br />2. The plans noted above shall be revised to provide for the following:
<br /> (a) Add decks to each condominium unit;
<br />
<br /> lb) Add fireplaces to not less than nineteen (19) of the condominium units.
<br />
<br /> 3. The development will be a condominium development with units sold on an individual
<br />basis and same will not be retained by the developer for rental purposes.
<br />
<br /> 4. The average sales price for units within the development will be Sixty-five Thousand
<br />Dollars ($65,000)."

<br /> 85-17- (f) Motion of Mr. Gray and seconded by Mr. Beamer, to reconsider Item 85-177(f)

<br /> On motion of Mrs. Webb and seconded by Mr. Whitlow, the following resolutior was adopted
<br />and by the following vote:

<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-SS OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING
<br />KNOWN AS "COLUMBIA PLACE CONDOMINIUMS" AND CONSISTING OF 36 CONDOMINIUM UNITS AND
<br />DtSIGNATED AS GHP-S5~19." (See fulI resolution on page 69)

<br /> Motion of Mr. Whitlow and seconded by Mrs. Webb, that Item 85-185(b) be withdrawn, and
<br />was adopted by unanimous vote.

<br />An 18-unit multi-family residential rental housing project in the City of
<br />Portsmouth by ~ssuance of its Industrial Development Revenue Bonds in an
<br />amounn not to exceed $500,000 for J. D. Erin and Associates, a Virginia
<br />General Partnership.
<br />
<br /> Motion of Mrs. Webb and seconded by Mr. Gray, that Item 85-185(e) be deferred to the
<br />meeting of August 27, 1985, and was adopted by unanmmous vote.
