<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amende
<br />and
<br />
<br /> WHEREAS, the planning Commission has reviewed said application and site plans submitted
<br />therewith and has recommended a conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pur-
<br />suant to Section 40-55 grants only an exemption from certain requirements for residences as
<br />stated in said section and does not constitute a waiver of any other requiremen~ embodied in
<br />the subdivision ordinance, zoning ordinanse, Code of the City of Portsmouth, Virginia, or
<br />any other applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws ore regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of forty eight (48) rental apartment units for
<br />the elderly to be located on a 1.75 acre vacant parcel 150' west of Martin Avenue and south
<br />of Portsmouth Boulevard and designated as GHP-85-23, and more specifically described in cor-
<br />respondence from George Eberwine, Jr., dated April 22, 1985 to the Director of Planning and
<br />filed with the appropriate officials of the City of Portsmouth, Virginia, such being made a
<br />part hereof, is hereby granted approval subject to the following terms and conditions:

<br /> 1. A standard site improvement plan must

<br />condominium units on land east of Washington Street between Columbia
<br />and South Streets, approved on first reading at the regular meeting
<br />July 9, 1985, was taken up and read.

<br />spoke concerning modifications presented.

<br /> Robert Dolsey, 327 High Street, representing Downtown Portsmouth Merchants Association,
<br />spoke in support of GHP 85-19 and GI~ 85-24.

<br /> On motion of Mrs. Webb and seconded by Mr. Whitlow, the following resolution was adopted
<br />on final reading, and by the following vote:

<br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br /> 40-SS OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING
<br /> KNOWN AS "COLUMBIA PLACE CONDOMINIUMS" AND CONSISTING OF 36 CONDOMINIUM UNITS AND
<br /> DESIGNATED AS GHP-85-19.

<br /> WHEREAS, Master Development Corporation, by Alan C. Jenson, Architect, has made applica-
<br />tion pursuant to Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, for the
<br />granting and approval of a group housing project to be known as "Columbia Place Condominiums"
<br />consisting of thirty six (36) condominium units on ~ 1.089 acre parcel bounded by Washington,
<br />Columbia and South Streets, which parcel is more particularly described as follows:
