<br />reading, and was adopted by unanimous vote. (Recommendation df the Planning Commission)

<br />H. Nicholson, Jr., has made application pursuant to Section 40-55 of the
<br />of Portsmouth, Virginia, 1973, for the grant~ng and approval of a group
<br /> of one hundred twenty (120) garden apartment units on 5.069 acres
<br /> Chowan Drive and Cherokee Road; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of Section 40-55; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended conditional approval of said applications; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan
<br />to Section 40-55 grants only an exemption from certain requirements for residences as stated
<br />in said section and does not constitute a waiver of any other requirement embodied in the sub-
<br />division ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other
<br />applicable local, state, or federal law or regulatioh; and
<br />
<br /> WHEREAS, the developer ~s aware that building permits or any other required permit will
<br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of one hundred twenty (120) garden apartment
<br />units known as 'Chowan Trace" to be constructed on 5~069 acres located in the southwest corner
<br />of Chowan Drive and Cherokee Road and designated as GHP-85-21 and more specifically described
<br />in correspondence received by the Planning Office on May 8, 1985 as shown on plans filed with
<br />the appropriate officials of the City of Portsmouth, Virginia, such being made a part hereof,
<br />is hereby granted approval subject to the following terms and conditions:
<br />
<br /> 1. A standard site improvement plan must be submitted to the Department of Engineering
<br />and Technical Services which includes an adequate number of handicapped parking spaces and
<br />provides adequate access to dumpsters for sanitation vehicles.

<br /> 2. Prior to issuance of building permits, a landscape plan must be finalized identifying
<br /> plant material to be ~nstalled and submitted to the Planning Staff for review and approval
<br />

<br /> TO OPERATE A CHILD CARE CENTER AT 715 SU~4BRS PLACE (UP-$5-17).

<br /> WHEREAS, The Cathederai of Praise Church, by John O. and Linda N. ~cCloud, Trustees, has
<br />made application pursuant to Section 40~75 (b) of the Code of the City of Portsmouth, Virginia
<br />1973, for the granting of a use permit to operate a child care center at 715 Summers Place;
<br />and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of a use permit for the
<br />operation of a child care center.
