At a regular meeting of the City Council held on Tuesday, July 23, 1985, there were <br />present: <br /> <br /> James W. Holley, III, Ben A. Beamer, Sr., E. G. CorFrew, Jr., J. Robert Gray, <br /> L. Louise Lucas, Gloria O. Webb, Morton V. Whitlow, Assistant City Manager <br /> Roy W. Cherry, Steven Lieberman, City Attorney. <br /> <br /> Bishop Thomas E. ~alle~ of Twines Memorial Church opened the meeting with prayer, £ollow¢ <br />by the Pledge of Allegiance to the Flag. <br /> <br /> Gray, minutes of the called meeting of July 9, <br /> 9, 1985, to be approved as received, and was <br /> <br /> Motion of Mr. Beamer and seconded by Mr. <br />1985; minutes of the regular meeting of July <br />adopted by unanimous vote. <br /> <br />Mayor Holley welcomed all visitors in attendance. <br /> <br /> 85-205 Mayor Holley presented Certificates of Appreciation to Dr. James C. Sears[Kathry <br />Sears, wife, accepted Certificate on his behalfl of the Municipal Finance Commission and <br />Parking Authority; Garland R. Culpepper of Tidewater Regional Group Home: Shirley E. Winters <br />of Community Services Board, for services rendered. <br /> <br />85-206 Public Hearing on rezoning, use permit and group housing project applications: <br /> <br />(al Zoning Petition Z 85-31 <br /> <br />Rezoning application of the City of Portsmouth, by George <br />Minor, Jr., Attorney for the Virginia District Convocatio <br />of United Holy Church of America, Inc., for multi-family <br />development on the north side of Elliott Avenue between <br />Deep Creek and Frederick Boulevards; from Industrial M-1 <br />to Residential R-60-K Conditional. <br /> <br /> Motion of Mr. Whitlow and <br />meeting of August 13, 1985, as <br />vote. <br /> <br />seconded by Mrs. Webb, that Z 85-31 to be deferred to the <br />recommended by the City Manager, and was adopted by unanimous <br /> <br />lb) Use Permit UP 85-16 <br /> <br />- Use Permit application of the City of Portsmouth, by George <br /> Minor, Jr., Attorney for the Virginia Convocation of United <br /> Holy Church of America, Inc., for a day care center at the <br /> southeast corner of Deep Creek and Portsmouth Boulevards. <br /> <br /> Motion of Mr. Gray and seconded by Mr. <br />meeting of August 13, 1985, as recommended <br />vote. <br /> <br />Corprew, that UP 85-16 co be deferred ~o the <br />by the City Manager, and was adopted by unanimous <br /> <br />(c) Zoning~-Petitio~ Z 85-32 <br /> <br />Rezoning application of Carney Creek Association, Owner, <br />for multi-family development at 3510, 3552, 3600 3608 <br />Cardinal Lane: from Residential R-150 to Residential <br />R-75-K Conditional. <br /> <br /> W. McMillan Powers, P. O. Box 189, representing Carney Creek Associates, requested for <br />the application co be withdrawn. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, that Z 85-32 be withdrawn, as requested <br />and was adopted by unanimous vote. <br /> <br />(d) Use Permit UP 85-14 <br /> <br />Use Permit application of January 16 associates, by Benjamin <br />J. Levy, General Partner, for a convenience store with gaso- <br />line pumps on property on the west side of Towne Point Road <br />lying south of Bickford Parkway and approximately 650' north <br />of Churchland Boulevard. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, that Items UP 85-14, UP 85-15, Z 85-35, and <br />GHP 85-26 to be taken concurrently, and was adopted by unanimous vote. <br /> <br />Ben Levy, 2908 Replica Lane, spoke in support of the four (4) referenced items. <br /> <br /> On motion of Mr. Beamer and seconded by Mrs. Webb, ~o concur in the recommendation of <br />the Planning Commission, UP 85-14 for a convenience store with gasoline pumps on proFer~y <br />on the west side of Towne Point Road lying south of Bickford Parkway and approximately 650' <br />north of Churchland Boulevard, was approved on first reading, and was adopted by unanimous <br />Fore. <br /> <br />the <br />located <br />reading, <br /> <br /> Qe) Use Permit UP 85-15 Use Permit application of Peachtree Associates, by Benjamin <br /> J. Levy, General Partner, for a convenience store with gasoli <br /> pumps on property located at the northwest corner of Twin <br /> Pines Road and Towne Point Road. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of <br />Planning Commission, UP 85-15 for a convenience store with gasoline pumps on property <br /> at the northwest corner of Twin Pines Road and Towne Point Road, was approved on first <br /> and was adopted by unanimous vote. <br /> <br /> <br />
