<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:

<br />1. That the special exception to be granted:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood:
<br />
<br /> (bi Will not be detrimental to the public use or injurious ~o the property or im-
<br />provements in the neighborhood; and
<br />
<br /> (c[ Will be in accord with the purposes and objectives of the Downtown D-1 District
<br />and the Zoning Chapter of the City Code.
<br />
<br /> 2. T. A. Edwards is hereby granted a special exception to the off-street parking require
<br />ments in the Downtown D-1 District as provided for mn Section 40-121(b)(IV) for the property
<br />located at 313 High Street by the granting of a variance of twenty-three (23) spaces for the
<br />commercial, office use of said property, such special exception being approved subject to the
<br />following conditions:

<br />to commercial/office space on the ground floor.

<br /> "The City of Portsmouth recently solicited proposals for a consulting engineering firm to
<br />complete a Utility Master Plan for the PortCentre business park project. In accordance with
<br />the applicable purchasing laws, a contract has been negotiated with the firm of C. B. Maguire,
<br />Inc. C. E. Maguire, Inc. was selected through competitive negotiation based on the strength
<br />of their proposal and qualifications.
<br />
<br /> The proposed contract with C. E. Maguire, Inc. ~s for the sum of $49,500 and calls for
<br />the completion of survey work, assessment of existing utilities and streets, and the develop-
<br />ment of a comprehensive Utility Master Plan for the PortCentre project.
<br />
<br />Funds for this project are available in the 1984-85 Capital Improvement Program, page 105
<br />
<br /> It is recommended that the contract with C. E. Magu~re, Inc. be approved, and that $49,50
<br />be appropriated frcm the 1984-85 CIP for this purpose.
<br />
<br /> Motion of Mr. Beamer and seconded by Mrs. Lucas, to approve the ordinance on first
