?7, lqg~ <br /> <br />UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br /> On <br />reading <br />reading, <br /> <br />motion of Mr. Gray and seconded by Mrs. Lucas, the following items approved on first <br />at the Public Hearing and regular meeting of August 13, 1985 were adopted on final <br />and by the following vote: <br /> <br />8S-222 - Use permit application: <br /> <br />(b) <br /> <br />"A RESOLUTION GRANTING A USE PE~IT TO WILLIE L. SAUNDERS FOR CONVERSION <br />TO A DUFLEX AY 59 LINDEN AVENUE. <br /> <br /> WHEREAS, Willie L. Saunders <br />and (11) of the Code of the City <br />permit as hereinafter~described; <br /> <br />has made application pursuant <br />of Portsmouth, Virginia, 1973, <br />and <br /> <br />to Section 40-102(B) (10) <br />for the granting of a use <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighbo~hood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements of the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Willie L. Saunders is hereby granted a use permit pursuant to Section 40-102(B)(10) <br />and (11[ of the Code of the City of Portsmouth, Virginia, 1973, to convert property at 59 <br />Linden Avenue from single-family dwelling to a duplex. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a[ The owner shall comply with the necessary approval requirements from the <br />Commission of Architectural Review for on-site parking; <br /> <br /> (b) The owner shall obtain all necessary permits for conversion constructmon <br />required by the Portsmouth City Code." <br /> <br />85-224 <br /> <br />"AN ORDINANCE TO APPROPRIATE $1S,000 FROM THE GENERAL FUND FOR INITIAL <br />COSTS AND OPERATING EXPENSES FOR A MOUNTED POLICE PATROL." <br /> <br />85-232 <br /> <br />"AN ORDINANCE TO APPROPRIATE $620,000 FROM THE CAPITAL IMPROVEMENT <br />TO COMPLETE THE PHASE I REHABILITATION AND IMPROVEMENTS OF WILLETT <br />AUDITORIUM." <br /> <br />FUND <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br />Other Items Under Unfinished Business <br /> <br />85-222 Parking Variance: <br /> <br />(e)(1) Request of Kirk Berkeley, architecT, for a special exception to off-street <br /> parking requirements at 313 High Street in the Downtown D-1 District. <br /> <br /> Councilman Whitlow stated he would abstain on the matter as he was representing the <br />opponent. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the following resolution approved on <br />first reading at the Public Hearing of August 13, 198S, was adopted and by the following <br />vote: <br /> <br />"A RESOLUTION GRANTING A SPECIAL EXCEPTION TO T. A. EDWARDS FOR PROPERTY AT 313 HIGH <br />STREET FOR OFF-STREET PARKING IN THE DOWNTOWN D~i DISTRICT. <br /> <br /> WHEREAS, T. A. Edwards, by Kirk Berkeley, Architect, has made application for the grantin <br />of a special exception to the off-street parking requirements for property at 313 High Street <br />pursuant to Section 40-121(b)(IV) in the Downtown D-1 District; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has made a recommendation for the granting of a special <br />exception to the off-street parking requirements. <br /> <br /> <br />
