' <br /> <br />Motion of Mr. Beamer to adopt died due the lack of a seconded. <br /> <br />The City Manager recommended a deferral on the item. <br /> <br /> Substitute motion of Mrs. Webb and seconded by Mr. Gray, that the matter be tabled, and <br />was adopted by unanimous vote. <br /> <br /> 85-244 Letter from the City Manager recommending adoption of an ordinance to appropriat <br />$200,000 for City's participation of 50% of construction and installation of brick sidewalks <br />in the downtown area of the D-1. <br /> <br /> "Included in this year's Capital Improvement Budget were funds to stimulate quality <br />development in Olde Towne South. The program was established to allow 50-50 sharing of costs <br />for~streetscapes/landscaping if the developer met certain design criteria ..e., brick sidewalk <br />ornamental street lights/poles, tree wells etc. By providing this in:entive, it:is beneficial <br />to both the City and developer by (1) speeding up a phase of downtown redevelopment, and (2) <br />making developer's project more attractive for marketing. <br /> <br /> To date, two developers have formalized their agreements to participate with seven others <br />expressing an xnterest in the program. A preliminary estimate for all n~ne projects is <br />$200,000 (see attached). The return on investment far outweighs the City's contribution; <br />therefore, I recommend Council's approprxation of $200,000 for this phase of the program.' <br /> <br /> Councilman Whitlow stated that he would abstain on the matter as his law firm would be <br />representing several developer's who would be participating in the project. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Gray, that the following ordinance to be approved <br />on first reading, and was adopted by 6-0-1 (Abstaining-Whitlow) vote: <br /> <br />"AN ORDINANCE TO <br />PARTICIPATION OF <br />OF SIDEWALKS AND <br /> <br />APPROPRIATE $200,000 FROM THE CAPITAL IMPROVEMENTS FUND FOR <br />THE CITY IN 50% OF THE COST OF CONSTRUCTION AND INSTALLATION <br />PUBLIC rMPROVEMENTS IN THE DOWNTOWN D-1 AREA.' <br /> <br /> 85-245 Letter from the City Manager recommendbng adoption of an ordinance to amend <br />certain sections of Chapter 23 of the City Code pertaining to motor boats and watercraft. <br /> <br /> "The City Attorney's office has completed a review of the cptions available to the City <br />pursuant to the State Code pertaining to the removal or repair of hazardous or obstructing <br />docks, wharves, piers, pilings, bulkheads or other structures or vessels and recommends the <br />adoption of Section 23-507.1 as shown on the attached ordinance. In addition, this review <br />reveals that certain sections of Chapter 23 pertainigg to motor boats and watercraft should <br />be revised in accordance with changes made by the Virginia General Assembly. <br /> <br /> The attached ordinance prepared by the City Attorney incorporates these changes, and I <br />join him in recommending adoption of this ordinance." <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was adopted on <br />first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1975, <br />BY AMENDING SECTIONS 23-501, 23-506, 23-507, 25-507.1, AND 23-514 OF CHAPTER <br />23 tHEREOF, PERTAINING TO MOTOR BOATS AND WATERCRAFT" <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> <br />
