110 <br /> <br />September 10~ 1925 <br /> <br /> 85-263 Letter from the City Manager recommending adoption of a resolution authorlzzng <br />the City Manager to enter into an agreement with Hampton Roads Sanitation District for the <br />sale of certain City sanitary sewage facilities. <br /> <br /> "At its August 27, 1985 meeting, the Hampton Roads Sanitation District approved a contra <br />with the City of Portsmouth to incorporate the City into the service district. <br /> <br /> The basic terms of this agreement provide for HRSD to purchase the Pinners Point sewage <br />treatment facility, three pump stations and certain sanitary sewer force mains from the City <br />for approximately $4.5 million. The property will actually be transferred as of July i, 1988 <br /> <br /> In the event that HRSD should terminate operations of the Pinners Point sewage treatment <br />plant in the future, the property will be reconveyed to the City at no cost. In addition, <br />HRSD will be responsbile for reimbursement to the Federal Government if such termination of <br />operations is found to be in violation of the Federal Grant Program. <br /> <br /> In my opinion, this agreement is advantageous for both Hampton Roads Sanitation District <br />and the citizens of the City of Portsmouth. To HRSD, it gives to them our Federal grant that <br />they would not have reaeived, and to us, it is a ~savzngs oF over ~32 million. Had Portsmouth <br />citizens been required to install secondary treatment at the Pinners Point Plant, the cost <br />would have been $32 million, and in order to pa)- for such expenses, utilities bills would have <br />eventually had to be increased over the next five years of over one hundred percent. <br /> <br /> I, therefore, recommend adoption of the attached resolution authorizing the <br />to execute the attached agreement and to further authorize such legal proceedings <br />required to incorporate the City into the Hampton Roads Sanitation District." <br /> <br />City Manager <br />as may be <br /> <br /> On mormon of Mr. Beamer and seconded by Mr. Corprew, the following resolution was adopted <br />and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH HAMPTON <br />ROADS SANITATION DISTRICT FOR THE SALE OF CERTAIN CITY SANITARY SEWAGE FACILITIES; <br />ADTHORIZING THE INSTITUTION OF CERTAIN LEGAL PROCEEDINGS NECESSARY TO INCORPORATE <br />A PORTION OF THE CITY INTO HAMPTON ROADS SANITATION DISTRICT. <br /> <br /> WHEREAS, the City and Hampton Roads Sanitation District have negotiated an agreement <br />for the sale of certain sanitary sewage facilities to Hampton Roads Sanitation District; namel <br />the Pinners Point Sewage Treatment Plant, the Camden Avenue Pump Station, the Rodman Avenue <br />Pump Station, the Elmhurst Lane Pump Station, and certain sanitary sewage force mains; and <br /> <br />WHEREAS, the transfer of said property is to be effective July 1, 1988; and <br /> <br /> WHEREAS, at the time of said transfer Hampton Roads Sanitation District shall assume <br />responsibilit~ for treatment and isposal of sewage in that portion of the City presently <br />being served by the Portsmouth Public Utilities Department; and <br /> <br /> WHEREAS, the procedures set forth by the General Assembly of Virginia for adding addi- <br />tional territory to Hampton Roads Sanitation District requzre that a petition requesting <br />approval of such action be filed with the local Circuit Court. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to enter ~nto an agreement with Hampton <br />Roads Sanitation District for the sale of certain City sanitary sewage facilities. <br /> <br /> BE IT FURTHER RESOLVED that the City Attorney be, and he hereby is, authorized to insti- <br />tute certain legal proceedings in the Circuit Court of the City of Portsmouth to incorporate <br />that portion of the City presently being served by the Portsmouth Public Utilities Department <br />· nto Hampton Roads Sanitation District." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-264 Letter from the City Manager recommending a motion for approval of the request <br />of applicant to withdraw a street closure application for a portion of Powhatan Avenue. <br /> <br /> "Darrell F. and Beverly G. Nuckles and David A. and Maryann S. Mitchell made application <br />to close a portion of Powhatan Avenue. Viewers were appointed, and both their reaommendation <br />an~ that of the Planning Commission's were to deny this application. <br /> <br />The applicants have now requested that their application be withdrawn. <br /> <br />I recommend that Council adopt a mormon approving their request for withdrawal." <br /> <br /> Gregory M. Pomije, Attorney, 801 Court Street, representing residents of Westhaven, <br />requested ~hat the application be denied. <br /> <br /> Motion of Mrs. Webb <br />Planning Commission, the <br />the following vote: <br /> <br />and seconded by Mr. Gray, ~o concur in the recommendation of the <br />application to close a portion of.~Powhatan Avenue was denied, and by <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> <br />
