August 25, 2026 <br /> <br />(h) All taxes and fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(i) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth herein are not satisfied within three (3) years of the date <br />of approval by City Council. <br /> <br />(j) In accordance with Zoning Ordinance Section 40.2-533(L), this Use Permit may <br />be revoked by City Council after conducting a public hearing. The permit may be revoked <br />if Council finds: <br /> <br />i. The Use Permit was obtained or extended by fraud or deception; <br />ii. The applicant has failed to comply with one or more of the conditions of approval; <br />iii. There has been a change in conditions affecting the public health, safety, and <br />welfare, since the adoption of the Use Permit; or <br />iv. There are repeated violations of this Ordinance by the holder of the Use Permit, <br />related to the development approved by the Use Permit. <br /> <br />REVOCATION OF PERMIT: <br />7. Blakley of TRG <br />Community Development for a Use Permit for the development of <br />a multi-family dwelling for persons 55 years of age or older on the <br />property at 3993 Twin Pines Road in the Multi-Family Urban <br />Residential District (UR-M). The property is owned by the <br />Portsmouth Redevelopment and Housing Authority. The property <br />is approximately 3.73 acres. The Future Land Use Map in the Build <br />One Portsmouth Comprehensive Plan designates this property for <br />multi-family residential uses. <br /> <br />1. Alisa Winston, Executive Director, Portsmouth Redevelopment and Housing <br /> Authority, 3116 South Street, presented the application. <br /> <br />2. David House, P. O. Box 3002, voiced his concern with the number of handicap <br /> accessible units. <br /> <br />3. Alexandra Westfall, 4102 Scott Street, voiced her concern with the number of <br /> handicap accessible units. <br /> <br />4. Tony Goodwin, 36 Linden Avenue, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Tillage, adopt the following resolution <br />and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-26-07) TO TRG COMMUNITY <br />DEVELOPMENT TO CONSTRUCT AND OPERATE A FOUR-STORY SENIOR LIVING <br />MULTI-FAMILY DWELLING HAVING NOT MORE THAN EIGHTY-TWO RESIDENTIAL <br />UNITS LOCATED AT 3993 TWIN PINES ROAD (TAX PARCEL 0846-0028). <br /> <br /> <br />WHEREAS <br /> , TRG Community Development has made application pursuant to <br />Section 40.2-533 of the Code of the City of Portsmouth, Virginia for the granting of a use <br />permit to construct and operate a four-story senior living multi-family dwelling having not <br />more than eighty-two residential units and located at 3993 Twin Pines Road (Tax Parcel <br />0846-0028); and <br /> <br />WHEREAS <br /> , Portsmouth Redevelopment and Housing Authority, the owner of the <br />subject property, has consented to the application; and <br /> <br /> <br /> <br /> <br />
