<br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements
<br />thereon, and the appurtenances thereunto belonging, situate, lying and being in the City
<br />of Portsmouth, Virginia, and known as 1211 Rodman Avenue, composed of Lots 22 and
<br />24 and Part of Lot 20, in Block 188, on the plat of VIRGINIA REALTY AND INVESTMENT
<br />COMPANY of record in the Clerk’s Office of the Circuit Court of the City of Chesapeake,
<br />Virginia, in Map Book 7, at Pages 98, 99 and 100, the parcel being described as follows,
<br />to-wit: BEGINNNING at the northeast intersection of Rodman Avenue and Race Street,
<br />and from thence running east along the north side of Race Street 72.25 feet to an iron
<br />pin; thence north 2 degrees 2 minutes east, parallel with Rodman Avenue, 71.97 feet to
<br />an iron pin; thence north 47 degrees 2 minutes east, 17.73 feet to an iron pin, thence
<br />north 2 degrees 2 minutes east, parallel with Rodman Avenue, 23.99 feet to an iron pin;
<br />thence north 87 degrees 58 minutes west, parallel with Race Street, 84.79 feet to Rodman
<br />Avenue, and thence south 2 degrees 2 minutes west, along the east side of Rodman
<br />Avenue, 108.5 feet to the point of beginning.

<br />IT BEING the same property conveyed to Kevin Michael Alexander and Keith Alexander
<br />by Deed of Gift from Keith Alexander and Anna Dail Alexander dated April 15, 2026 and
<br />recorded in the Clerk’s Office of the Circuit Court for the City of Portsmouth, Virginia as
<br />Instrument Number 202604296.

<br /> 6. That the use permit is approved subject to the following conditions which
<br />shall be observed by the applicant and any successor in interest:
<br />
<br />(a) The development shall be in substantial compliance and conformity with the
<br />submitted conceptual site plan and building elevations for UP-26-06, except where
<br />modifications may be required to comply with all applicable local, state, and federal codes
<br />and regulations.
<br />
<br />(b) No more than a total of seven (7) townhouse dwellings shall be constructed on the
<br />subject properties.
<br />
<br />(c) No abutting townhouse dwellings shall have the same design.
<br />
<br />(d) Prior to obtaining Site Plan Review approval, a Plat subdividing the subject
<br />properties into seven (7) parcels for townhouse dwelling units and complying with all
<br />applicable requirements of Chapter 33.1 of the City Code (Subdivisions) must be
<br />approved by the City and recorded by the applicant or a successor in interest.
<br />
<br />(e) A Plan of Development/Site Plan in compliance with all applicable local, state, and
<br />federal codes and regulations, including without limitation those set forth in Chapter 11.1
<br />of the City Code (Erosion and Stormwater Management), must be approved by the City
<br />prior to commencement of construction of the development.
<br />
<br />(f) A restrictive covenant shall be placed of record in the land records of the
<br />Portsmouth Circuit Court, as part of a broader declaration or otherwise, ensuring that no
<br />trash cans shall be stored in the front yard of any townhouse dwelling unit.
<br />
<br />(g) The site shall be developed in compliance with all applicable codes, ordinances,
<br />and regulations of federal, state, and local government, and all required licenses and
<br />permits shall be obtained prior to construction and remain in effect during the
<br />development of the proposed use.
