Wheatley, Director of <br />Operations for Development, for commercial expansion at <br />1412 Hamilton Avenue; from RBsidential R-75-S to Com- <br />mercial C-2-K Conditional. <br /> <br /> Councilman Whitlow stated he would abstain because his law firm's representation of the <br />ultimate user of the proposed site. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of the <br />Planning Commission, to rezone for commercial expansion at 1412 Hamilton~Avenue, from Residen- <br />tial R-75-S to Commercial C-2-K Conditional, the following ordinance was approved on first <br />reading by 5-0-1 (Abstaining-Whitlow)~vote: <br /> <br />"ZONING ORDINANCE AMENDMENT 2 85-36" <br /> <br />(b) Use Permit UP 85-21 <br /> <br />Use permit application of Lonnie Simms, by Marvin Goldfarh, <br />owner, for an auto service station at 3311 Hartford Street. <br /> <br />Marvin Goldfarb, 3201 Dogwood Drive, stated he was available to answer questions. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, to concur in the recommendation of the <br />Planning Commission, UP 85-21 for an auto service station at 3311 Hartford Street, was approve, <br />on first reading by unanimous vote. <br /> <br />(c) Use Permit UP 85-22 Use permit application of Johnny Owens 8 R. D. Knauft, owners <br /> for conversion to a duplex at 434 Chautauqua Avenue. <br /> <br />The following letter was received from Johnny Owens, owner: <br /> <br /> "During the first week of August the Planning Commission recommended unanimously for u~ <br />to convert a single house to a duplex at 434 Chautauqua Avenue, Portsmouth. It was suppose <br />to go to City Council on September 24th, but due ~o another commitment of the Council, it was <br />delayed until tonight. We are trying to get the work done on the property but we need permits <br />and can not get the permits until Council approves the conversion. I would appreciate very <br />much if this is approved that you would waive the second reading and 50 day waiting period, so <br />that we can get in and get the work done on the property, and also get our financing and insur <br />ance on the property. ~his was applied for back in July and these waiting periods are causing <br />us problems with our insurance and financing. I have talked to the City Clerk, the City Attor: <br />and the Planning Director, they advised me to ask for this waiver. Sign by Johnny Owens" <br /> <br /> On motion oF Mr. Beamer and seconded by Mrs. Lucas, to concur in the recommendation of <br />the Planning Commission, for conversion to a duplex at 434 Chautauqua'Avenue, and that the <br />use permit to take effect immediately upon adoption on second reading, and was adopted by <br />5-1 (Nay-Whitlow) vote. <br /> <br />(d) GHP 85=28 <br /> <br />Group housing project application of Southern Rental, Inc. by Kirk <br />Berkeley, AIA, Architect, for 32 condominium units on land located <br />on the east side of Hodg~s Ferry Road, between Portsmouth Boulevard <br />and Logan Drive, lying behind the City of Portsmouth fire station. <br /> <br /> Kirk Berkeley, 303 Effingham Street, zepresenting applicant, spoke in support of the <br />application. <br /> Motion of Mrs. Lucas and seconded by Mr. Whitlow, to concur in the recommendation of &he <br />Planning Cnmmission.'- ~ . - ~ <br /> <br /> Mo~ion of Mr. Whitlow and seconded by Mr. Beamer, to suspend the rules for Hr. Berkeley <br />to speck again, and was ad.opte~ by unanimous vote. <br /> <br /> Mr. Berkeley spoke concerning the construction of the roof and stated that there had been <br />no objections from the residents surrounding the project. <br /> <br /> Substitute motion of Mr. Beamer <br />back to the Planning Commission and <br />by 5-1 (Nay-Lucas) vote. <br /> <br />and seconded by Mr. Gray that GHP 85-28 to be referred <br />to consider items that hBd been discussed, and was adopted <br /> <br />(e) GHP 84-22 <br /> <br />REVISED group housing project application of Portsmouth Partners, by <br />A. P. Ditteaux, general partner, for ~has~ I of the redevelopment of <br />River Edge Apartments into 50 12-unit ccndominiums. The apartments are <br />formerly known as Twin Lakes. <br /> <br /> A. P.
