A standard site improvement plan for Phase I must be submitted for approval to the <br />Engineering and Technical Services Department and include a detailed drawing of ex~sting <br />and proposed geometrics of the Cambridge and Detroit Streets entrance. <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Holley <br />Nays: None <br /> <br />84-326 <br /> <br />PARKING VARIANCE - <br /> <br />Request of Mr. John McGlynn, Owner by Kirk Berkeley, Architec~ <br />for a special exception of off-street parking requirements fo~ <br />proposed renovation and re-use of the Catholic Club at 450 <br />Court Street in D-1 District, approved on first reading at thc <br />regular meeting of October 1, 1985, was taken up and read. <br /> <br />Motion of Mrs. Lucas and seconded by Mr. Gray, to adopt the resolution. <br /> <br /> Motion of Mr. Beamer and seconded Mrs. Lucas, to amend the resolution Lo extend the time <br />of occupancy to nine (9) months, and was adopted by unanimous vote. <br /> <br /> On motion, the following resolution, as amended, was adopted on final reading by the. <br />following vote: <br /> <br />'A RESOLUTION GRANTING A SPECIAL EXCEPTION ~O JOHN O. McGLYNN FOR PROPERTY AT 450 <br />COURT STREET FOR OFE-STREE? PARKING IN THE DOWNTOWN D-1 DISTRICT. <br /> <br /> WHEREAS, John McGlynn has made application <br />the off-street parking requirements for property <br />(IV) in the Downtown D-1 District; and <br /> <br />for the grant~ng of a special exception to <br />a~ ¢50 Court Street pursuant to ~40-121 lb) <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has made a recommendation for the granting of a special <br />exception to the off-street parking requirements. <br /> <br />NOW, THEREFORE, BE Il RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the special exception to be granted: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood; <br /> <br /> (b) Will not be detrimental to the public use or ~njurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes and objectives of the Downtown D-1 <br />District and the Zoning Chapter of the City Code. <br /> <br /> 2. John McGlynn is hereby granted a special exception to the off-street parking require- <br />ments in the Downtown D-1 District as provided for in ~40-121 (b) (IV) for the property known <br />as the "Catholic Club" at 450 Court Street by the granting of a vartance of parking spaces for <br />the residential, commercial mixed use of said proper~y, such special exception being approved <br />subject to the following conditions: <br /> <br /> (a) The proFerny shall be developed to provide a mixture of uses for the building <br />consisting of a restaurant/lounge on the basement floor with ninety seven '97) sears, offices <br />consisting of approximately three thousand, three hundred ten (3,310') square feet on the <br />first floor and five (5) apartments on the second and third floors. <br /> <br /> (b) John McGlynn shall provide eight (8) on-site parking spaces and twenty eight (28] <br />off-street parking spaces in accordance with the requirements for parking contained in the Cod~ <br />of the City of Portsmouth, Virginia, 1973, as amended. <br /> <br /> (c) The variance is granted on the basis that 450 Court Street xs used in the manner <br />described here~n and any changes from such proposed use will constitut~ the expiration of the <br />variance hereby granted, <br /> <br /> (d) <br />p~rmits and <br />the date of <br />within said <br />is extended <br /> <br /> The variance is granted on the basis that the applicant obtain all necessary <br />approvals prior to occupancy, and that occupancy occur within n~ne (9) months from <br />the ~ssuance of:this resolution; provided, however, if occupancy is not obtained <br />nine (9) month period, the variance hereby granted shall expire unless such period <br />by resolution of this City Council.' <br /> <br />Ayes: Beamer, Corprew, 3ray, Lucas, Webb, Holley <br />Nays: Ncne <br /> <br /> <br />
