<br /> WHEREAS, Johnny Owens and Richard D. Knauft has made application pursuant to ~40-102 (B)
<br />for a use permit to convert an existing single,family residence to a duplex residence at 434
<br />Chautauqua Avenue which is located in the Port Norfolk Historic District; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of a use permit with condi-
<br />tions for the conversion of an existing single-family dwelling to a duplex residential structu~
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing in the
<br />neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code.

<br /> 2. Johnny Owens and Richard D. Knauft are hereby granted a use permit pursuant to
<br />~.40-102 ~(B) to convert an existing single-family residence to a duplex residential structure
<br />at 434 Chautauqua Avenue, such conversion to be in complicance with the regulations applicable
<br />to the-Port Norfolk Historic Residential Subdistrict as provided for in the Zoning Chapter
<br />of the Code of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted
<br />subject to the following term and condition:
<br />
<br /> (a) The applicant shall comply with all applicable codes, ordinance, policies and
<br />~rqgulations of the City of Portsmouth, Virginia, and shall obtain all necessary permits and
<br />".iicenses.

<br /> This resolution shall take effect immediately upon its adoption."

<br />GHP 84-22 - REVISED group housing project application of Portsmouth Partners, by
<br /> A. P. Ditteaux, general partner, for Phase I of the redevelopment of
<br /> River Edge Apartments (formerly Twin Lakes) into 50 12-unit condominium
<br /> approved on first reading at the Public Hearing of October 1, 1985, was
<br /> taken up and read.
<br />
<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted on
<br />final reading, and by the following vote:
<br />
<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING
<br />KNOWN AS "RIVER EDGE" PHASE I, AND CONSISTING OF 60 CONDOMINIUM UNITS AND
<br />DESIGNATED AS GHP-84-22 REVISED.
<br />
<br /> WHEREAS, Portsmouth Partners, by A. P. Ditteaux, General Partner, and Bush Construction
<br />Corporation, Managing General Partner, has made application pursuant to ~40-55 of the Code of
<br />the City of Portsmouth, Virginia, 1973, for the granting and approval of a revision to group
<br />housing project GHP-84-22; and
<br />
<br /> WHEREAS, the application includes Phase I of a ten (10) year project which will result
<br />in the construction of six hundred (600) condominium units, and Phase I includes sikty (60)
<br />condominium units for the Detroit Street area of Wallace Circle; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, by a resolution adopted
<br />January 8, 1985, granted approval for group housing project GHP-84-22, and the applicant has
<br />requested a review of a revision to such project which includes the same number of units,
<br />however, the site design and traffic patterns have been revised; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of ~O~SS, and said Commission has reviewed the application and site plan submitt
<br />therewith and has recommended conditional approval of the application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of the group housing project pur-
<br />suant to ~40-55 grants only an exemption from certain requirements for residences as stated
<br />in said section, and does not constitute a waiver of any other requirement embodied in the
<br />subdivision, ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any
<br />other applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />be issued only upon compIiance with the ordinances, laws or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by 2he Council of theCity of Portsmouth, Virginia, that
<br />the certain group housing project consisting of sixty (60) condominium units to be known as
<br />"River Edge" Phase I, to be constructed on an eight (8) acre parcel and designated as GHP-84-2~
<br />revised, and more specifically describe in correspondence and plans filed with the appropriate
<br />officials of the City of Portsmouth, Virginia, such being made a part hereof~ is hereby grante~
