162 <br /> <br />October 8, 1985 <br /> <br /> WHEREAS, the Director of Public Utilities has certified that only 20' of the 40' easement <br />will be necessary for operation of the existing facilities; and <br /> <br /> WHEREAS, it is the responsibility of the developer to provide additional utilities in <br />connection with the approved development plan. <br /> <br /> NOW, THEREFORE, BE TI RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to sign a Deed of Release for that 20' portic <br />of the easement on property formerly designated Gibbs Road between Victory Boulevard and <br />Dahlgren Avenue, said 20' no longer being necessary for Public Utility facilities. ' <br /> <br />Ayes: Beamer, Corprew, 5ray, Lucas, Webb, Holley <br />Nays: Ncne <br /> <br /> 85-309 Letter from the City Manager recommending adoption of a motion to refund $168.00 <br />(with interest) for 1985 Business License to Enoch Carrington. <br /> <br /> "The Commissioner of The Revenue is requesting a refund of 1985 Business License <br />Enoch Carrington, 2904 Lansing Avenue, Portsmouth, Virginia 23704. <br /> <br /> Mr. Carrington purchased his 1988 Rental License on May 1, 1985, but due to a computer <br />error he was charged double for his license. A refund of $168.00 ~with interest) is requested <br /> <br />I recommend that Council adopt this motion, and a refund be granted." <br /> <br /> Motion of Mr. Beamer and seconded by Mr. Gray, that authorization be granted to refund <br />to Enoch Carrington, 204 Lansing Avenue, Portsmouth, Virginia 23704, $168.00 for computer erro~ <br />on 1985 Rental License, and was adopted by unanimous vote. <br /> <br /> 85-310 Letter from the City Manager recommending adoption of a resolution to approve <br />the five-year Capital Improvement Plan for 1985-96 through 1989-90, and a one-year Capital <br />Improvement Budge~ for 1985-86. <br /> <br /> "On September 10, 1985, I presented to City Council, <br />Finance Commission at a public work sessmon the proposed <br />and the 1985-86 Capital Improvement Budget. <br /> <br />Planning Commission and Municipal <br />1985-90 Capital Improvement Program <br /> <br /> Since that time, a joint public hearing with the Planning Commzssion was held on October <br />1, 1985. Attached is a letter from Mr. Douglas Powell, Chairman of the Planning Commission, <br />indicating that by unanimous vote, the Planning Commission approved the 1985-90 Capital Improve <br />merit Program. Also, on September 17, 1985, the Municipal Finance Commission met and similarly <br />gave a recommendation to the City Council for the adoptmon of this budget. <br /> <br /> I believe the adoption of this Capital Improvement Budget will continue to create an <br />atmosphere conducive to private investment and to reinforce Council's adopted Goals and <br />Objectives. <br /> <br /> I, therefore, recommend adoption of the attached resolution approving the 1985-90 Capital <br />Improvement Program and the 1985-86 Capital Improvement Budget. <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adoFted, <br />and by the following vote: <br /> <br />'~A RESOLUTION APPROVING THE FIVE YEAR CAPITAL IMPROVEMENT PLAN FOR 1985-86 THROUGH <br />1989-90, AND A ONE YEAR CAPITAl IMPROVEMENT PROGRAM FOR 1985-86. <br /> <br /> WHEREAS, the City Manager has submitted to the City Coun.cil the Capital Improvement Plan <br />for 1985-86 through 1989-9C; and <br /> <br /> WHEREAS, the City Planning Commission and the Municipal Finance Commission have reviewed <br />said plan; and <br /> <br /> WHEREAS, a public hearing has been held to receive public comments on the Capital Improve- <br />ments Plan and on the General Revenue Sharing Funds included therein; and <br /> <br /> WHEREAS, the Council has considered <br />General Revenue Sharing Funds and finds <br />policies in regard to necessary capital <br /> <br />the Capital Improvement Plan and the utilization of <br />them to be in proper form and expressive of Council <br />improvements. <br /> <br /> NOW, THEREFORE, BE 11 RESOLVED [y the Council of the City of Portsmouth, Virginia, that <br />the aforesaid Capital Improvements Plan for the years 1985-86 through 1989-90 and a one year <br />Capital Improvement Program for 1985-86 are approved subject to later appropriation in the <br />ordinary course of business of the City.- <br /> <br />Ayes: Beamer, Corprew, Gray~ Luea~, Webb, ~iolley <br />Na~s: <br /> <br /> <br />
