Collins has made application to close the western portion of Augusta Terrace. <br /> <br /> The attached resoluton appoint, s viewers in accordance with applicable State law to view <br />the portion of such inconvenience would result in closing that portion of Augusta Terrace. <br /> <br />I, therefore, concur and recommend the adoption of the attached resolution." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION OF AUGUSTA TERRACE. <br /> <br /> WHEREAS, Albert L. Collins has made application to vacate, close and discontinue the <br />hereinafter described portion of Augusta Terrace, and it appearing that notice of application <br />and request for the appointment of viewers has been duly advertised as required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />A. N. Kendrick, Albert J. Cart, Howard L. Davis, George N. Powers, Sr., and C. L. Knight <br />appointed viewers and that H. G. Hairston and Richard D. Ottavio be appointed alternate viewer: <br />in the event one of the preceding viewers fails to participate, said viewers to view the <br />hereinafter-described portion of such street and to report to this Council in writing whether <br />in their opinion any, and if any what, inconvenience would result in vacating and closing the <br />following: <br /> <br />Western Portion of Augusta Terrace <br /> <br /> Ail that certain piece or parcel of land, situate in the City of Portsmouth, <br />Virginia, being designated as that portion of Augusta Terrace (formerly High Street) <br />running west from its intersection with Augusta Avenue (formerly Page Avenue) to <br />its western termination at a cove of the Western Branch of the Elizabeth River <br />between Blocks 2 and 10 as shown on the plat of the Portsmouth Suburban Investment <br />Company, duly recorded in the Clerk's Office of the Circuit Court of the City of <br />Chesapeake, Virginia, in Map Book 4, page 94." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Holley <br />Nays: None <br /> <br /> 85-308 - Letter from the City Manager recomending adoption of a resolution authorizing <br />the City Manager to sign a deed of release for a portion of a publiv utility easement on <br />property formerly designated Gibbs Roads. <br /> <br /> "In 1979, a portion of Gibbs Road between Victory Boulevard and Dahlgren Avenue was <br />closed by City Council. In connection with this street closure, an easement was reatained <br />for existing utility services. <br /> <br /> The property on either side of the former Gibbs Road has now become the subject of a <br />multi-family residential development. The owner and developer have requested that a portion <br />of the easement be released in order to facilitate building location for the project. The <br />Director of Public Utilities has advised that a twenty foot easement is adequate for present <br />and future utility purposes. <br /> <br /> The resolution on your agenda tonight would authorize the City Manager to release the <br />remaining twenty feet of the easement originally reserved. <br /> <br />I recommend adoption of this resolution." <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN A DEED OF RELEASE FOR A PORTION <br />OF A PUBLIC UTILITY EASEMENT ON PROPERTY FORMERLY DESIGNATED GIBBS ROAD. <br /> <br /> WHEREAS, by resolution adopted by the Council of the City of Portsmouth on February 13, <br />1979 that portion of Gibbs Road between Victory Boulevard and Dahlgren Avenue was closed and <br />vacated as a public right-o£-~ay~; and <br /> <br /> WHEREAS, said ordinance reserved to the City of Portsmouth an easement for the purpose of <br />installing, operating and maintaining Public Utility pipes and lines within the 40' width of <br />said street; and <br /> <br /> WHEREAS, the developer of adjacent property has requested a release of a portion of said <br />easement in connection with the construction of the muli-family residential development to be <br />known as Cradock Colonials; and <br /> <br /> <br />
