February 10, 2026 <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to construct a four-story multi-family dwelling <br />complex consisting of approximately 48 units on a portion of 3335 Victory Boulevard (Tax <br />Parcel 0534-0310), the said property being more particularly described as: <br /> <br />UP-25-13 <br /> <br />That certain portion of the below-described property (3335 Victory Boulevard) <br />approximately as shown on that certain concept site plan entitled “Blount Place – Site <br />Plan”, prepared by PCI Design Group, Inc., and dated November 28, 2025. <br /> <br />3335 VICTORY BOULEVARD <br />(Tax Parcel 0534-0310) <br /> <br />ALL THAT certain tract, piece or parcel of land with the buildings and improvements <br />thereon and the appurtenances thereunto belonging, situate, lying and being in the City <br />of Portsmouth, Virginia, containing 3.4346 acres, more or less, and designated on a <br />certain plat entitled, “BOUNDARY SURVEY OF 3335 VICTORY BOULEVARD, <br />PORTSMOUTH, VIRGINIA, PROPERTY OF SWEETBRIAR DEVELOPMENT <br />CORPORATION TO BE CONVEYED TO THE CITY OF PORTSOUTH”, dated March 28, <br />2000, revised February 2, 2005, prepared by Stephen I. Boone & Associates, P.C., Land <br />Surveyors, which said plat is recorded in Map Book 20 at Page 68 in the Clerk’s Office of <br />the Circuit Court of the City of Portsmouth, Virginia and to which reference is hereby made <br />for a more particular description. <br /> <br />IT BEING a portion of that certain property conveyed to Riptide IV LLC by Deed of Bargain <br />and Sale from Economic Development Authority of the City of Portsmouth, Virginia dated <br />June 30, 2021 and recorded in the Clerk’s Office of the City of Portsmouth, Virginia as <br />Instrument Number 202110325. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept site <br />plan entitled “Blount Place – Site Plan”, prepared by PCI Design Group, Inc. dated <br />November 28, 2025, except where modifications may be required to comply with all <br />applicable local, state, and federal codes and regulations. This condition is not intended <br />to preclude additional landscaping beyond that shown in the aforesaid concept site plan, <br />so long as the additional landscaping does not violate any applicable code or regulation. <br /> <br /> <br /> <br /> <br /> <br />
