January 13, 2026 <br /> <br />(c) Before initially operating any multi-family dwelling development as <br />apartments (rental units), the owner and/or operator shall install and maintain digital video <br />equipment with recording capabilities sufficient to indicate the date and time that the <br />recording is made. The recording shall provide surveillance coverage encompassing the <br />front, side, and rear exteriors of any rental unit development for 24 hours a day, 7 days a <br />week. Recorded data must be maintained in a condition permitting review of the <br />information for a period of no less than thirty (30) days. <br /> <br />(d) The development shall be constructed in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local government, and all <br />required licenses and permits shall be obtained and remain in effect during the operation <br />of the development. <br /> <br />(e) All taxes/fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br /> <br />(h) This Use Permit shall automatically expire and become void three (3) years <br />from the date of approval by City Council if the use is inactive or changed to a different <br />use, unless within such three-year period: (a) a building permit is obtained, and erection <br />or alteration of a structure is started; or (b) a Certificate of Occupancy is obtained, and <br />the approved use is commenced. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br /> <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Bryant, Dodson, Hugel, Moody, Tillage, Thomas, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br /> <br />Motion by Mr. Moody, and seconded by Mr. Hugel, to change the order of business <br />to adopt the City Manager’s Report with one vote, and was adopted by the following vote: <br /> <br />Ayes: Bryant, Dodson, Hugel, Moody, Tillage, Thomas, Glover <br />Nays: None <br /> <br />26 - 08 - Adoption of an ordinance accepting settlement funds in the amount of <br />$85,832.12 from the PFAS settlement with DuPont and appropriating said amount <br />in the FY 2026 Public Utilities Fund for use by the Department of Public Utilities for <br />water supply testing and treatment and other authorized uses under the terms of <br />the settlement. <br /> <br />Background: <br /> <br /> Several public water supply systems filed suit against the 3M Company, DuPont, <br />and other entities for historical contamination by PFAS (per- and polyfluoroalkyl <br />substances). The City of Portsmouth joined the litigation and the class action settlement. <br /> <br /> As a result of the settlement, the City will receive contributions from the settling <br />defendants over a period of several years for the testing and treatment of the City’s water <br />supply. <br /> <br />Discussion: <br /> <br /> The first settlement contribution of $150,714.13 was received from the 3M <br />Company in August 2025 and was appropriated by Ordinance 2025-72 adopted on <br /> <br />September 9, 2025 for use by the Public Utilities Department. <br /> <br /> The second settlement contribution of $288,215.13 was received from the 3M <br />Company in November 2025 and was appropriated by Ordinance 2025-103 adopted on <br /> <br />November 25, 2025. <br /> <br /> The third settlement contribution of $85,832.12 was received from DuPont in <br /> <br />December 2025 and must be appropriated by City Council.The settlement funds will be <br /> <br />used to help ensure the continued quality of the City’s water supply. <br /> <br /> <br /> <br /> <br /> <br /> <br />
