January 13, 2026 <br /> <br />LESS AND EXCEPT: <br /> <br />Those certain parcels shown as “Parcel 1” and “Parcel 2” on a certain plat of survey <br />entitled “Pump Station Site and Right of Way Dedication for the subdivision of New Port”, <br />dated January 7, 2008, prepared by LandMark Design Group and recorded in the <br />aforesaid Clerk’s Office as Map Book 21, Pages 205-207. <br /> <br />TOGETHER WITH: <br /> <br />Parcel A <br /> <br />All that certain lot, piece or parcel of land, situate in the City of Portsmouth, Virginia, <br />comprising 0.290 acres more or less, bounded and described as follows: <br /> <br />Beginning at the southwest corner of Elliott and Gygax Avenue; thence along the southern <br />right of way of Gygax Avenue S 41° 53’ 03” E a distance of 265.65 feet to a point; thence <br />N 39° 25’ 57” E a distance of 307.07 feet to the TRUE POINT OF BEGINNING; thence N <br />67° 11’ 07” E a distance of 247.60 feet to a point; thence S 39° 25’ 57” W a distance of <br />219.11 feet to a point; thence N 50° 34’ 03” W a distance of 115.29 feet to the TRUE <br />POINT OF BEGINNING, as shown on that certain plat entitled “Plat Showing Property <br />Owned by City of Portsmouth” dated February 14, 1975 prepared by the Department of <br />Engineering, City of Portsmouth, Virginia, that is attached to and made a part of that <br />certain Deed of Exchange dated April 8, 1975 that is recorded in the Clerk’s Office of the <br />Circuit Court of the City of Portsmouth, Virginia in Deed Book 662, at page 38. <br /> <br />Parcel B <br /> <br />All that certain lot, piece or parcels of land, situate in the City of Portsmouth, Virginia and <br />bounded and described as follows: <br /> <br />Beginning at the southwest intersection of Elliott Avenue and Gygax Avenue; thence <br />along the southern right of way of Gygax Avenue S 41° 53’ 03” E a distance of 265.65 <br />feet to the TRUE POINT OF BEGINNING; thence N 39° 25’ 57” E a distance of 307.07 <br />feet to a point; thence S 50° 34’ 03” E a distance of 48.63 feet to a point; thence S 48° <br />25’ 57” W a distance of 310.89 feet to the TRUE POINT OF BEGINNING as shown on <br />that certain plat entitled “Plat Showing Property Owned by City of Portsmouth” dated <br />February 14, 1975, prepared by the Department of Engineering City of Portsmouth, <br />Virginia, that is attached to and made a part of that certain Deed of Exchange dated April <br />8, 1975 that is recorded in the Clerk’s Office of the Circuit Court of the City of Portsmouth, <br />Virginia in Deed Book 662, at page 38. <br /> <br />IT BEING: (1) all that certain property conveyed to New Port Property Investors, L.C. by <br />Special Commissioner’s Deed from Jason A. Dunn dated January 31, 2025 and recorded <br />in the Portsmouth Circuit Court Clerk’s Office as Instrument Number 202501073; and (2) <br />all that certain property conveyed to New Port Property Investors, L.C. by Quitclaim Deed <br />from Portsmouth Partners of Virginia dated August 13, 2025 and recorded in the <br />Portsmouth Circuit Court Clerk’s Office as Instrument Number 202509556. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the site plan <br />concept entitled “New Port – Phase 2 Conceptual Master Plan” prepared by Land <br />Planning Solutions, dated May 5, 2025, and revised November 10, 2025, except where <br />modifications may be required to comply with all applicable local, state, and federal codes <br />and regulations. <br /> <br />(b) The development shall be in substantial compliance with the rendered <br />concept elevations entitled “New Port Phase Product Types” prepared by Land Planning <br />Solutions and submitted September 19, 2025, except where modifications may be <br />required to comply with all applicable local, state, and federal codes and regulations. <br /> <br /> <br /> <br /> <br /> <br />
