<br /> The City Attorney's Office has prepared the attached resolution which would authorize
<br />me to execute a deed of exchange, I concur with the recommendation of Mr. Jim SFacek; and
<br />therefore, recommend your approval.
<br /> Motion of Mrs. Webb and seconded by Mrs. Lucas, for approval.
<br /> Motion of Mrs. Webb and seconded by Mrs. Lucas, that Item 85-345 be moved to the end
<br />of the Agenda, a~rt~e reqnest of tZe City Attorney to review the matter, and was adopted by
<br />unanimous vote.
<br />
<br /> 85-346 Letter from the City ~anager recommending adoption of a resolution authorizing
<br />the City Manager to convey certain property to the City of Suffolk.
<br />
<br /> "Suffolk's City manager John L. Rowe has requested that the City of Portsmouth consider
<br />selling two small parcels of property in Suffolk to allow for the construction of sewage pump
<br />station. An independent appraisal has been conducted and the value of the property has been
<br />established at $1,000.
<br />
<br /> The City's Director of Public Utilities has evaluated Mr. Rowe's request and feels that
<br />the proposed improvements would benefit both communities. Mr. Spacek has indicated that the
<br />expansion of!the gravity sewer collection system into the Oakridge neighborhood will have a
<br />positive impact on reducing septic tank malfunction problems and their impact on the Lake
<br />Speight watershed.

<br /> The City Attorney had drafted the attached resolution which authorizes the City to convey
<br />the property in question to the City of Suffolk. Based upon the positive recommendation of
<br />the Director of Public Utilities, I, therefore, recommend City Council's approval £or the sale
<br />of property in that amount of $1,000 with the understanding that the City of Suffolk would
<br />incur the cost of the appraisal."

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adopted
<br />and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CERTAIN PROPERTY TO THE
<br />CITY OF SUFFOLK.
<br />
<br /> WHEREAS, the City of Portsmouth owns
<br />which property is no longer required for
<br />be excess property; and
<br />
<br />certain property located in the City of Suffolk
<br />Public Utility purposes and is, hereby, declared
<br />
<br />tO
<br />
<br /> WHEREAS, the City of Suffolk desires to acquire a portion of said property in order to
<br />construct two sewage pumping stations; and
<br />
<br /> WHEREAS, the City of Suffolk has agreed to pay the appraised value of said parcels and
<br />the cost of the appraisal; and
<br />
<br /> WHEREAS, an independent appraisal has placed a total value of $1,000.00 on the parcels;
<br />and
<br />
<br /> WHEREAS, Section 2.09 (c) of the Charter of the City of Portsmouth provides that the
<br />City may convey property to the Commonwealth of Virginia or a political subdivision thereof
<br />without advertisement and receipt of bids; and
<br />
<br />WHEREAS, the City of Suffolk is a political subdivision of the Commonwealth of Virginia.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to convey to the City of Suffolk, upon
<br />receipt of payment of the appraised value and the cost of the appraisal, the following
<br />described properny, to-wit:

<br />Parcel 1
<br />
<br /> All that certain piece or parcel of land, situate, lying and being ~n the City
<br />of Suffolk, Virginia, bounded and described as follows: beginning at a point on
<br />the western boundary of Manning Road, said point being the point of intersection of
<br />the western boundary of Manning Road with the southern boundary of Lot 2B as shown
<br />on that certain plaz entitled "Section No. 1 Barrett Acres" recorded in the Clerk's
<br />Office of the Circuit Court of the City of Suffolk, Virginia, (formerly Nansemond
<br />County) in Deed Book 9, page 55; thence in a westerly direction along the boundary
<br />of said Lot 2B 25' to a po~nt~ thence south and parallel with Manning Road 26' to
<br />a point: thence eas~ 25' to a point on the western boundary of Manning Road;
<br />thence north along the western boundary of Manning Road 26' to the point of
<br />beginning.

<br />
<br /> All that certain piece of parcel of land, situate, lying and being ~n the
<br />City of Suf£ol~ Virginia, bounded and described as follows: beginning at a
<br />point on the southern boundary of Faulk Road, said point being the pomnt of
<br />intersection of the southern boundary of Fautk Road and the boundary of lots 8
<br />and 9 as shown on that certain plat entitled "Plat of Pinaire Subdivision"
<br />recorded in the Clerk's Office of the Circuit Court of the Deed Book 9, page 31;
<br />thence south along ~he boundary of said lots 8 and 9, 24' ~o a point; thence
<br />east 30' to a point: ~hence north 32' to a point on the southern boundary of
<br />Faulk Road; thence along a curve to the left 30', more or less, to the point of
<br />beginning."
