<br /> 85-304 Ordinance to amend Section 10 of the City of Portsmouth, Virginia, Classificatio~
<br />and Pay Plan, Ordinance No. 1985-43, pertaining to overtime and repealing Sections ll(a), (b),
<br />(i), (k) pertaining to additional compensation firefighters and police officers, deferred
<br />from the regular meeting of October 22, 1985.

<br />The following letter was submitted by the City Manager:
<br />
<br /> "As you know, the Fair Labor Standars Act was scheduled to take effect for local govern-
<br />ment employees on October 15. The effective date was later extended until November 1. Recent
<br />legislation passed by Congress will, when signed by the President, make major changes in the
<br />Act's impact on local government. As a result of these changes, I am recommending that you
<br />refer this matter back to me for luther study.
<br />
<br /> Attached is a summar of key provismons of the compromise legislation. The major change
<br />is that the FLSA will not apply to local government until April 15, 1986. Other changes are
<br />made concerning compensatory time off in lieu of overtime, volunteer services, dual employment
<br />etc. I will be glad to answer any questions you may have concerning the effect of the new
<br />legislation on Portsmouth.

<br /> If you concur with my recommendation to refer this matter back to me, I will report to
<br />at a later date on our plans to comply."

<br /> "The flew Farm Fresh center on George l~ashington Highway is a significant asset to the Cit)
<br />of Portsmouth. The retail sales tax alone on the super savor store (i00,000 square feet)and t]
<br />adjacent retail (41,250 square feet) will generate more than 2385,000 in revenue for the City.
<br />the Total private investment is $6 million (including roadway widenings, curb and gutter, side-
<br />walks and medians).
<br />
<br /> During the construction, a storm drain line in need of repair was discovered along George
<br />Washington Highway which was inadequate ro accommodate traffic loading and therefore, had to
<br />be replaced. It totally serves the public right-of-way and is considered gn improvement beyond
<br />the normal site development requmrements. The developer replaced the line at his cost and now
<br />that the project ms complete, has requested that the City participate in a sharing of the costs
<br />incurred during construction.
<br />
<br /> The work in question was done to City specifications with prior review by the Department
<br />of Planning, Engineering and Inspections. In addtion, City Inspectors visited the site to
<br />ensure that the project was completed to City specifications. I should also note that the City
<br />share (50%) was based upon recent projects bid_by the City. The price established for the pro-
<br />ject was $27,360.
