September 24, 2024 <br /> <br />Next Steps Following Council Action: <br /> <br /> Sign and return grant agreement to the Department of Conservation and <br />Recreation. <br /> <br />Motion by Mr. Hugel, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE ACCEPTING A COMMUNITY FLOOD PREPAREDNESS GRANT IN <br />THE AMOUNT OF $624,600 FROM THE VIRGINIA DEPARTMENT OF <br />CONSERVATION AND RECREATION AND APPROPRIATING SAID AMOUNT IN THE <br />STORMWATER CATEGORY OF THE FY 2025 CAPITAL IMPROVEMENT FUND <br />BUDGET TO COMPLETE THE FINAL PHASE OF THE CITY’S STORMWATER <br />MODEL. <br />” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />24 - 278 - Adoption of a resolution authorizing the City Manager to approve a <br />change order totaling more than 25% of the original contract price of the contract <br />with Tidewater Utility Construction, Inc. for the Court Street Green Street Project. <br /> <br />Background: <br /> <br /> The Court Street Green Street Project is a demonstration project that incorporates <br />complete street concepts and green infrastructure to treat stormwater flows on top of a <br />street segment within an area that is part of the Downtown Master Utility project. <br /> <br /> The retrofit of Court Street satisfies one of the city’s stormwater permit <br />requirements for retrofit projects during the 5-year permit cycle. <br /> <br />Discussion: <br /> <br /> Unanticipated conditions associated with aging facilities and conflicting records <br />required additional work to upgrade and replace water and sanitary sewer facilities. <br /> <br /> Unanticipated delays associated with private utility relocation slowed production <br />during 2022 and resulted in a work stoppage from Sept 2022 until August 2023. <br /> <br /> Contract prices were renegotiated due the delays. Most of the price adjustments <br />were associated with subcontractor pricing. <br /> <br /> Quantity overruns are the result of unsuitable soils and other unanticipated <br />conditions. <br /> <br /> Section 2.2-4309 of the State Code and Section 12-183 of the City Code provide <br />that no fixed-price contract may be increased by more than 25% of the amount of the <br />contract or $50,000, whichever is greater, without the advance approval of the governing <br />body. <br /> <br />Financial Impact: <br /> <br /> The original contract price was $3,920,333.05 and change orders in the amount of <br /> <br />$948,981.43 have been approved. <br /> <br /> <br /> The state contributed $2,232,712 to fund the project. <br /> <br /> Additional funds in the amount of $1,529,087.10 are necessary to complete the <br /> <br />project. <br /> <br /> <br /> Funds are available in the CIP to cover the cost of completing the project. <br /> <br />Recommended Action: <br /> <br /> Adoption of the Resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> Proceed with the proposed work and submit the appropriate paperwork for the <br />changes to the contract. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Tillage, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br /> <br /> <br /> <br /> <br /> <br />
