September 24, 2024 <br /> <br />“RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A CHANGE <br />ORDER TOTALING MORE THAN 25% OF THE ORIGINAL CONTRACT PRICE OF <br />THE CONTRACT WITH TIDEWATER UTILITY CONSTRUCTION, INC. FOR THE <br />COURT STREET GREEN STREET PROJECT. <br /> <br />WHEREAS, <br /> the Court Street Green Street Project (the “Project”) is a <br />demonstration project that incorporates “Complete Street” concepts and green <br />infrastructure to treat stormwater flows on top of a street segment within an area that is <br />part of the Downtown Master Utility Project; and <br /> <br />WHEREAS, <br /> the Project satisfies one of the City’s MS-4 Stormwater Permit <br />requirements for performing retrofit projects and has been partially funded by state grants <br />in the amount of $2,232,712.62; and <br /> <br />WHEREAS, <br /> in 2021 Tidewater Utility Construction, Inc. submitted the low bid for <br />the Project and was awarded the contract for an original price of $3,920,993.05 (the <br />“Original Contract Price”); and <br /> <br />WHEREAS, <br /> the City provided a Notice to Proceed with the Project on August 16, <br />2021; and <br /> <br />WHEREAS, <br /> the following factors have resulted in the Project costing more than <br />anticipated: <br /> <br /> Unanticipated conditions associated with aging facilities and conflicting records <br />required additional work to upgrade and replace water and sanitary sewer facilities; <br /> <br /> Unanticipated delays associated with private utility relocations necessary to <br />perform the work caused slowdowns in 2022 and resulted in a work stoppage from <br />September 2022 until August 2023; <br /> <br /> The delays resulted in increased subcontractor pricing as construction costs in <br />general spiked during the period of performance of the Project; <br /> <br /> Unsuitable soils and other unanticipated conditions increased costs. <br /> <br />WHEREAS, <br /> as a result of these factors, previous change orders in the amount of <br />$948,981.43 have been approved and it is anticipated that an additional $1,529,087.10 <br />is necessary to complete the Project; and <br /> <br />WHEREAS, <br /> Section 12-183 of the City Code requires Council approval to increase <br />an original fixed price contract amount by more than 25% or $50,000, whichever is <br />greater; and <br /> <br />WHEREAS, <br /> funding to cover the additional $1,529,087.10 is available in the <br />Capital Improvement Fund budget. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that, pursuant to Section 12-183 of the City Code, the City Manager is authorized <br /> <br />to expend the additional funds necessary to complete the Project.” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />24 - 279 - Adoption of a resolution certifying the City of Portsmouth’s support of an <br />application for a Virginia Department of Housing and Community Development Port <br />Host Community Revitalization Fund Grant in the amount of $1,000,000 in <br />furtherance of the revitalization of 1040 Virginia Avenue for port-related uses. <br /> <br /> <br />Background: <br /> <br /> In 2019 the Virginia General Assembly created the Port Host Community <br />Revitalization Fund. <br /> <br /> Under the terms of the Fund, the five Port Host Communities (Portsmouth, Front <br />Royal, Newport News, Norfolk and Richmond) are able to apply for grants from an annual <br />pool of $2,400,000. <br /> <br /> <br /> <br /> <br />
