Motion by Ms. Lucas-Burke, and seconded by Mr. Barnes, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE ACCEPTING FUNDING FROM THE VIRGINIA DEPARTMENT OF SOCIAL SERVICES IN THE AMOUNT OF $2,400 AND APPROPRIATING SAID AMOUNT IN THE FY 2025 SOCIAL SERVICES FUND BUDGET FOR THE FAMILY PARTNERSHIP MEETING INCENTIVE PROGRAM. ” Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Glover Nays: None 24 - 226 - Adoption of an ordinance amending and reordaining Article IX (Offenses Against Property) of Chapter 24 of the Code of the City of Portsmouth, Virginia by amending Section 24-316 (Removal or Repair of Defacement of Buildings, Walls, Fences or other Structures) to modify subsections (c) and (e) and add a new subsection (f) for the purpose of conforming the City’s available remedies for defacement of property to the provisions of the Virginia Code. Background:  Two different sections of the Virginia Code offer remedies to address defacement of structures. The first, Section 15.2-1812.2, is primarily a criminal statute. It was incorporated as Section 24-316 of the City Code in 1995.  The second, Section 15.2-908, authorizes the City to employ civil remedies to require the removal or repair of graffiti or defaced property. Section 15.2-908 has never been fully incorporated into the City Code. Discussion:  The proposed ordinance incorporates the remedies available under Section 15.2- 908 of the Virginia Code into Section 24-216 of the City Code.  This will allow the City to require property owners to remove or repair defacements of structures. If the owner does not do so after the City has provided 15 days’ notice, then the City will be authorized to undertake or contract for the removal or repair itself. In addition, if the structure is unoccupied and the City performs the repairs, it will have the right to charge the cost to the owner. Financial Impact:  None.
