August 13, 2024 <br /> <br />Background: <br /> <br /> <br /> The Craney Island Disposal Area is a 2,500-acre confined dredged material site <br />developed in the 1940s to provide a long term-disposal area for material dredged from <br />the channels and ports of Hampton Roads. <br /> <br /> The Disposal Area is owned by the United States and controlled by the Army Corps <br />of Engineers. <br /> <br /> In 1973, the United States granted the City a 15-foot stormwater drainage <br />easement across the Craney Island Disposal Area for the placement of a 24-inch <br />drainage pipe. <br /> <br /> The drainage easement serves the area of Rivershore Road and Parish Lane. <br /> <br />Discussion: <br /> <br /> <br /> The easement agreement had a term of 50 years and expired in 2023. <br /> <br /> The Army Corps of Engineers has offered to grant the City another easement <br /> <br />located in the same area and for the same stormwater facilities. <br /> <br /> The Army Corps of Engineers will charge the City approximately $9,000 for the <br />easement. $9,000 is the estimated cost to the Corps to perform the mapping and create <br /> <br />the documentation that it deems necessary to grant the easement. <br /> <br />Financial Impact: <br /> <br /> <br /> The cost of the easement will be approximately $9,000. There is funding <br />available in the Stormwater Fund Budget to pay the cost. <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The Army Corps of Engineers will prepare the easement documents. <br /> <br />Motion by Mr. Hugel, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE ACQUISITION OF A STORMWATER DRAINAGE <br />EASEMENT FROM THE UNITED STATES OF AMERICA (CRANEY ISLAND <br />DISPOSAL AREA). <br /> <br />WHEREAS, <br /> by Easement for Right of Way dated October 10, 1973, as <br />supplemented by Supplemental Agreement No. 1 dated August 6, 1974 and <br />Supplemental Agreement No. 2 dated April 12, 1999, the United States of America, <br />through the Secretary of the Army, granted the City a 15 foot stormwater drainage <br />easement for the placement of 24 inch drainage pipe to the north of Rivershore Road, as <br />shown on Exhibit A hereto (the “Prior Easement”); and <br /> <br />WHEREAS, <br />the term of the Prior Easement was fifty years and it has now expired; <br />and <br /> <br />WHEREAS, <br /> the Army Corps of Engineers has offered to grant the City a new <br />easement for the same location; and <br /> <br />WHEREAS, <br /> the cost of the new easement is anticipated to be $9,000, which is the <br />Army’s internal cost for preparing the new easement documents; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the acquisition of a new easement to <br />replace the Prior Easement for a purchase price of approximately $9,000, and be it further <br />resolved that the City Manager is authorized to deliver the purchase price and execute <br />such documents or instruments as may be necessary or desirable in furtherance of the <br /> <br />intent of this Resolution.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br />
