August 13, 2024 Background:  The Virginia General Assembly has provided funding for the Virginia Department of Environmental Quality (“DEQ”) to expand the statewide groundwater observation well network.  The observation wells monitor the quality of groundwater in the Commonwealth.  DEQ has requested that the City grant easements to install chloride monitoring wells at the Lake Kilby Water Treatment Facility. Discussion:  The Lake Kilby Water Treatment Facility is located in Suffolk on property owned by Portsmouth and is part of the City of Portsmouth’s reservoir and water distribution system.  The easements requested by DEQ will not hinder Portsmouth’s operations.  It is in the interest of both the City and the Commonwealth to monitor the groundwater supply to ensure potable water. Financial Impact:  None. Recommended Action:  Adoption of resolution. Next Steps Following Council Action:  DEQ will determine the exact location of the proposed easements.  The City Manager will execute easement documents as deemed appropriate. Motion by Ms. Lucas-Burke, and seconded by Mr. Hugel, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION GRANTING EASEMENTS TO THE VIRGINIA DEPARTMENT OF ENVIRONMENTAL QUALITY TO INSTALL AND ACCESS CHLORIDE MONITORING WELLS AT THE LAKE KILBY WATER TREATMENT FACILITY. WHEREAS, the Lake Kilby Water Treatment Facility, located on Tax Parcel 34G15(7)*1 and adjoining parcels in the City of Suffolk (the “Property”), is part of the Portsmouth water reservoir and distribution system; and WHEREAS, the Virginia General Assembly has provided funding for the Virginia Department of Environmental Quality (“DEQ”) to expand the statewide groundwater observation well network; and WHEREAS, as part of the expansion, DEQ has requested that the City grant easements to install and access chloride monitoring wells on the Property; and WHEREAS, it is in the interest of both the City and the Commonwealth to monitor and protect the water supply; and NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby approves and authorizes the conveyance of the requested easements to the Virginia Department of Environmental Quality in such form and at such locations on the Property as the City Manager may approve, and that the City Manager is hereby authorized to execute such documents or instruments as may be necessary or desirable in furtherance of the intent of this Resolution.” Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Glover Nays: None 24 - 232 - Adoption of a resolution authorizing the acquisition of a stormwater drainage easement from the United States of America (Craney Island Disposal Area).
