<br /> WHEREAS, the City of Portsmouth and its surrounding cities have significant low lying
<br />areas subjectmo flooding, many of which are residential in character; and
<br />
<br />WHEREAS, the St. Julien's Creek Annex Area lies within the 100-year Flood Plain; and
<br />
<br /> WHEREAS, Article III, Section 2.3Cb) of the proposed regulations under
<br />the HazardousB%aste Siting Board of Virginia states 'that 'no hazardous waste
<br />sited in a 100-year Flood Plain'; and
<br />
<br />consideration by
<br />facility shall be
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, has expressed its concern with
<br />the establishment of a hazardous waste storage facility at St. Julien's Creek Annex and oppose
<br />its establishment at that site unless it was determined to the satisfaction of this Council
<br />and the affected citizens that the facility would not have a significant environmental impact
<br />on the quality of life and the health and well-being of the residents of this City and the
<br />surrounding areas; and
<br />
<br /> WHEREAS, the general public is more protected by prohibiting sitings in a
<br />Plain rather than allowing sitings subject to monitored flood-proofing, as such
<br />subject to human error and material failure; and
<br />

<br /> WHEREAS, the effects of the distribution of hazardous waste material stored in a 100-yea~
<br />Flood Plain will be disastrous and the extent of damages unforeseeable; and
<br />
<br /> WHEREAS, the City wan~s to insure its citizens and those of the surrounding communities
<br />the greatest degree of protection.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />it endorses the proposed hazardous waste regulation known as Article III, Section 2.3]b].
<br />
<br /> BE 17 FURTHER RESOLVED that the City Clerk be, and she hereby is, directed to forward
<br />copies of this resolution to the Hazardous Waste Facility Siting Board of Virginia, Congress-
<br />man Norman-Sisisky, Senator John W. Warner, Senator Paul S. Trible, Jr., and the appropriate
<br />officials of the Department of Defense."

<br />public conference with the General Assembly.
<br />
<br /> "Arrangements have been made with the members of the Portsmouth delegation to the Genera
<br />Assembly to review the City legislative agenda on December 16, 1985 at 6:30 p.m. mn the Brief-
<br />ing Center, Centr&l Fidelity Bank Building. I recommend adopzion of the resolution on your
<br />agenda tonight to establish the schedule for this public conference."

<br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the following resolution was adopted,
<br />and by the following vote:

<br />"A RESOLUTION SCHEDULING A PUBLIC CONFERENCE TO BE HELD WITH THE PCRTSMOUTH DELEGATION
<br />TO THE GENERAL ASSEMBLY OF VIRGINIA AT THE BRIEFING CENTER, 3RD FLOOR, CENTRAL FIDELITY
<br />BANK BUILDTNG ON DECEMBER 16, 1985 AT 6:30 p.m.
<br />
<br /> WHEREAS, the Council of the City of Portsmouth and the Portsmouth delegation to the
<br />General Assembly of Virginia will hold its annual public conference for discussion of Legis-
<br />lative Proposals for 1986; and
<br />
<br /> WHEREAS, the public is invited to attend and observe the public conference on the
<br />legislative Proposals for 1986 of the City of Portsmouth.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by this Council of the City of Portsmouth, Virginia, that
<br />a public conference be held with the Portsmouth delegation to the General Assembly of Virgini~
<br />at the Briefing Center, 3rd Floor, Central Fidelity Bank Building on December 16, 1985 at 6:30
<br />p.m. at which time the Council will consider its Legislative Proposals for 1985."

<br /> 85-396 Letter From the City Manager recommending adoption of a resolution requesting
<br />the General Assembly of Virginia to amend the Charter of the City of Portsmouth, Virginia,
<br />by repealing the Section pertaining to the Office of the High Constable.
<br />
<br /> "As Council_is aware, with the submittal of the 1985-86 budge~, I recommended, with the
<br />concurrence of the High Constable, that the position of High Constable be abolished.
<br />
<br /> Official action mus: now be taken by the City Council requesting the Legislature to amend
<br />our Charter removing any reference of the High Constable.
<br />
<br />Attached is a resolution prepared by the City Attorney, and I recommend its adoption."
