December 10, 1985 <br /> <br /> 85-393 Letter from the City Manager recomme,nding adoption of an ordinance amending <br />Chapter 23 of the City Code pertaining to motor vehicles and traffic in regards to motor <br />vehicles travelling on City streets. <br /> <br /> "The City Traffic Engineer's review of the restricted use of certain streets in the City <br />from truck traffic has resulted in the designation of an additional number of streets in which <br />truck traffic has become a problem which has necessitated the installation of signs restrictin <br />movement of trucks greater, in size, than standard pickups (10,000~pounds). It should be <br />noted that the next section of the City Code requires that trucks greater than 36,000 pounds <br />be limited to those routes designated by the City as truck routes. <br /> <br /> In reviewing the request of the Traffic Engineer, the City Attorney also recommends <br />certain technical revisions of those portions of the City Code that deal with trucks and othe] <br />oversized vehicles, and the proposed amendments will bring the Code into conformity with cur- <br />rent practices. <br /> <br /> I, therefore, recommend the adoption of the attached ordinance amending certain portions <br />of Chapter 23 of the City Code." <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was adopted on <br />first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTS~OUTH, VIRGINIA, 1973, AS <br />~ENDED, BY ~\{ENDING SECTIONS 23r13, 23-520, 23-525, AND 23-529 OF CHAPTER 23 <br />THEREOF, PERTAINING TO MOTOR VEHICLES AND TRAFFIC." <br /> <br />Ayes: Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-394 Letter from the City ~{anager recommending adoption of a resolution endorsing the <br />prohibition of siting a hazardous waste facility in a one hundred year flood plain. <br /> <br /> "As you are aware, the State Hazardous Waste Siting Council resently held public hearings <br />throughout the State on its proposed regulations. Fhe oroposed regulations set certain pro- <br />hibitions for the siting of facilities. These D~o~Yihit~ons include: wetlands, 100 flood plains <br />dam failure inundation zones, sinkholes, locati4ns near active faults and within areas desig- <br />nated as national natural landmarks or lands in public trust. <br /> <br /> Of particular concern to the City of Portsmouth is the proposed St. Julien's Creek Annex <br />Hazardous Waste Facility. It is imFortant that the State Siting Council include the prohibi- <br />tion for facilities located within the 100 year flood plain and for that reason the City <br />Attorney has prepared the attached resolution endorsing this provision~ <br /> <br />I concur with the proposed resolution and I recommend Council's favorable consideration." <br /> <br /> Albert Stone, 12 Harris Road, Vice President of St. Julien's Creek Citizens Committee, <br />spoke in support of the resolution. <br /> <br /> Jesse Overton, 82 Ericsson Street, representing Secretary of <br />Committee, spoke briefly on material to be forwarded to the ~ayors <br />(See Exhibit 85-394) <br /> <br />St. Julien's Creek Citizens <br /> of the Tidewater area. <br /> <br /> Councilman Gray stated that a letter had been <br />to action taken by the Executive Committee of the <br />supporting the resolution. <br /> <br />received from Ms. Shirley Winters relative <br />Tidewater Federation of Wcmen's Clubs, <br /> <br /> The following letter was received from Barbara Wright, President of Cradock Property <br />Owners' Association: <br /> <br /> "The Cradock Property Owners' Association members have indicated very strong support for <br />City Manager Hanbury's recommendatmon fo~ a City resolution endorsing prohibition of siting a <br />hazardous waste facility in a 100 year flood plain ~December 10, 1985 Agenda Item 86-39~). <br /> <br />We respectfully request favorable action by Portsmcuth City Council on this matter." <br /> <br />Councilman Gray thanked Mr. Overton for all his efforn on this matter. <br /> <br /> On motion of Mr. Gray and seconded by ~rs. Webb, the following resolution was adcpted, <br />and by the following vote: <br /> <br />"A RESOLUTION ENDORSING THE PROHIBITION AGAINST SITING HAZARDOUS WASTE FACILITIES <br />IN A iO0-YEAR FLOOD PLAIN. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, by adoption of resolutions on July 24, <br />1984, October 9, 1984 and October 22, 1985 expressed its concerns zo establishing a hazardous <br />waste storage facility at St. Julien's Creek Annex; and <br /> <br /> WHEREAS, the Hazardous Waste Facility Siting Board of Virginia is in the process of <br />provzng regulations concerning the siting of hazardous waste facilities in Virginia; and <br /> <br /> WHEREAS, the regulations are of vital importance to all areas of Virgznia and of oarti- <br />cular importance to areas under consideration for the siting of a hazardous waste storage <br />facility; and <br /> <br /> <br />
