July 9, 2024 <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to operate a shipping container/chassis storage <br />yard at 0 Coast Guard Boulevard (Tax Parcel 0719-0110), the said property being more <br />particularly described as: <br /> <br />UP-24-04 <br /> <br />0 Coast Guard Boulevard <br />(Tax Parcel 0719-0110) <br /> <br />ALL THAT certain parcel of land lying and being in the City of Portsmouth, Virginia, being <br />more particularly described as follows: <br /> <br />Beginning at a point in the dividing line between land formerly owned by Virginia Holding <br />Corporation (now owned by Transcontinental Gas Pipe Line Corporation) and land of the <br />United States Coast Guard at its intersection with the western line of Coast Guard <br />Boulevard; thence along the western line of Coast Guard Boulevard S 61°05’30” W <br />464.63 feet to a pin; thence continuing along the western line of Coast Guard Boulevard <br />on a curve having a radius of 702.0 feet 142.89 feet to a pin; thence continuing along the <br />western line of Coast Guard Boulevard S 49°25’45” W 118.78 feet to a pin; thence N 86° <br />20’ 40” W 159.81 feet to a point; thence N 78°20’10” W 631.24 feet to a point; thence N <br />80°59’30” W 593.44 feet to a point in the approximate center of an unnamed creek the <br />western line of land formerly owned by Virginia Holding Corporation (now owned by <br />Transcontinental Gas Pipe Line Corporation); thence following the approximate center <br />line of said creek, the western boundary of said land as follows: N 16°11’20” W91.65 feet <br />to a point; thence N 52°18’20” E 55.61 feet to a point; thence S 88°48’10” E 239.05 feet <br />to a point; thence S 51°54’10” E 205.85 feet to a point; thence N 55°18’10” E 79.06 feet <br />to a point; thence N 17°58’10” E 311.18 feet to a point; thence N 34°48’20” E 227.74 feet <br />to a point; thence N13° 36’34” E 293.23 feet to a point corner to aforesaid land formerly <br />owned by Virginia Holding Corporation (now owned by Transcontinental Gas Pipe Line <br />Corporation) and land of United States Coast Guard; thence leaving the center line of <br />said creek with the dividing line between lands S 46°42’48” E 174.99 feet to the toe of the <br />bank; thence N 86°15’25” E 1834.68 feet to the point of beginning; said parcel consists <br />of 30.244 acres more or less and as shown on plat recorded in Deed Book 588, Page <br />292. <br /> <br />BEING a part of the property conveyed to Virginia Holding Corporation by Deed from <br />Transcontinental Gas Pipe Line Corporation dated June 9, 1983 recorded in the <br />Portsmouth Circuit Court Clerk’s Office in Deed Book 857, Page 612. <br /> <br /> 6.
