July 9, 2024 <br /> <br />(a) The development shall be in substantial compliance and conformity with the <br />concept plan entitled “Conceptual Site Plan 1” prepared by VHB dated April 9, 2024 and <br />revised June 19, 2024, except where modifications may be required due to improvements <br />recommended by the Traffic Impact Analysis, as well as to comply with all applicable <br />local, state, and federal codes and regulations. <br /> <br />(b) In addition to general standards, the proposed use shall be designed and operated <br />in accordance with the use-specific standards for shipping container/chassis storage yard <br />uses outlined in Section 40.2-217(H)(3)(b) of the Zoning Ordinance. <br /> <br />(c) A Site Plan must be submitted for review and approval in accordance with the <br />requirements of the Site Plan Review process. If applicable, a Water Quality Impact <br />Assessment (WQIA) shall be required for all land disturbances within the Resource <br />Protection Area. <br /> <br />(d) The development must be in compliance with Chapter 14.1 of the City Code (Flood <br />Protection Ordinance). <br /> <br />(e) Prior to initially operating the approved use and so long as the use remains in <br />operation, the owners and/or operators shall install and maintain digital video equipment <br />with recording capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the subject <br />property for 24 hours a day, 7 days a week. Recorded data must be maintained in a <br />condition permitting review of the information for a period of no less than thirty days. <br /> <br />(f) The development must be constructed in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments, and all required <br />licenses and permits must be obtained prior to construction and remain in effect during <br />the operation of the development. <br /> <br />(g) Prior to commencement of the use, an access easement or similar grant of rights <br />in form and location acceptable to the United States Coast Guard must be provided <br />across a portion of the subject property to give the Coast Guard additional ingress and <br />egress to and from its property. <br /> <br />(h) Prior to commencement of the use, owner/applicant shall cause, at its sole cost, <br />construction of a left turn lane along Coast Guard Boulevard substantially as shown on <br />the “Conceptual Site Plan 1” prepared by VHB dated April 9, 2024 and revised June 19, <br />2024. <br /> <br />(i) Prior to commencement of the use, an 8’ high barbed wire fence shall be installed <br />along the property line of the Coast Guard facility bordering the subject property. <br /> <br />(j) During Coast Guard live fire training exercises, no parking on the subject property <br />shall be permitted within the blast radius for the shooting range on the Coast Guard <br />property. <br /> <br />(k) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City Treasurer. <br /> <br />(l) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years of the date <br />of approval by City Council. <br /> <br />(m) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit <br />may be revoked by City Council after conducting a public hearing. This permit may be <br />revoked if Council finds: <br /> <br /> (i) The Use Permit was obtained by fraud or deception; <br /> (ii) The applicant has failed to comply with one or more of the conditions of <br />approval; <br /> <br /> <br /> <br /> <br />
