March 26, 2024 <br /> <br />(m) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years of the date <br />of approval by City Council. <br /> <br />(n) In accordance with Section 40.2-533(L) of the Zoning Ordinance, this Use Permit <br />may be revoked by City Council after conducting a public hearing. This permit may be <br />revoked if Council finds: <br /> <br /> (i) The Use Permit was obtained by fraud or deception; <br /> (ii) The applicant has failed to comply with one or more of the conditions of <br />approval; <br /> (iii) There is a change in conditions affecting the public health, safety, and welfare, <br />since adoption of the Use Permit; or <br /> (iv) There are repeated violations of the Zoning Ordinance by the holder of the Use <br />Permit related to the development approved by the Use Permit. <br /> <br />REVOCATION OF PERMIT: <br />7. Violation of any of the conditions set forth <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />(c) AP-24-01 CITY-WIDE - Resolution granting the request of the City to adopt a <br />Plan for the Innovation District. The new document will be titled <br />City of Portsmouth Innovation District Plan. The Plan will <br />recommend strategies and tactics for achieving the identified goals, <br />and recommendations for funding and tools for implementing the <br />strategies and tactics. Planning Commission recommends <br />approval. <br /> <br />1. Brian Swets, Planning Administrator, presented the application. <br /> <br />2. JoAnn Clark, 4717 Thornwood Street, spoke in opposition to this item. <br /> <br />Motion by Dr. Whitaker, and seconded by Mr. Barnes, to defer Item AP-24-01 to <br />the June 11, 2024, City Council meeting, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />24 - 77 - Adoption of an ordinance establishing a Personal Property Tax Relief <br />Percentage of 50% for Calendar Year 2024 Personal Property Tax Bills. <br /> <br />Background: <br /> <br /> In accordance with the Virginia Personal Property Tax Relief Act (PPTRA), the city <br />is required to annually establish the personal property tax relief percentage to be applied <br /> <br />to qualified vehicles. <br /> <br /> The 2005 revisions to the Personal Property Tax Relief Act of 1988 (“the 2005 <br />Amendments”) modified the method of state reimbursement for personal property tax <br /> <br />relief from a variable percentage to a fixed sum of money payable to each locality. <br /> <br /> The 2005 Amendments and Section 35-9 of the Portsmouth City Code require that <br />the city annually establish a personal property tax relief percentage such that the total <br />relief provided to qualifying taxpayers will exhaust the funds to be allocated to the locality <br /> <br />by the Commonwealth. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
