March 26, 2024 IT BEING the same property conveyed to Printcraft Press, Inc. by Deed of Gift from Drew F. Dixon and Carol Dixon dated May 7, 1996 and recorded in the Portsmouth Circuit Court Clerk’s Office in Deed Book 1184 at Page 795. 6. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The child day center shall comply with the use-specific standards set forth in Section 40.2-217(E)(1) of the Zoning Ordinance. (b) Where required by the Zoning Ordinance, all external site and building improvements, including the proposed playground fencing, and any signage, must be approved through issuance of a Certificate of Appropriateness (COA) by the Downtown Design Committee (DDC) prior to the commencement of work. (c) Prior to initially operating the approved use and so long as the use remains in operation, the owners and/or operators shall install and maintain digital video equipment with recording capabilities sufficient to indicate the date and time that the recording is made. The recording shall provide surveillance coverage encompassing the front, side, and rear exteriors of the establishment for 24 hours a day, 7 days a week. Recorded data must be maintained in a condition permitting review of the information for a period of no less than thirty days. (d) Prior to any land disturbance on the subject property, a Site Plan must be submitted to the Engineering Department for review and approval as and to the extent required by the City Code. All excavation, land disturbance, and construction/development activities on the property must be in full compliance with the City Code. (e) Prior to initially operating the approved use, a Zoning Permit from the City Zoning Administrator and a Certificate of Occupancy (CO) from the Department of Permits and Inspections must be obtained. (f) Prior to initially operating the approved use, the operator must obtain permission from the Engineering Department to utilize Guardian Court, or develop an alternative plan that is approved by the Engineering Department, for the pickup and delivery of children in a way that does not require children to have to cross vehicular travel ways to enter or exit the center. (g) The operator shall be required to install and pay the cost of any improvements required to provide a designated safe drop-off and pick-up area. (h) The operator must prepare plans for late opening and early dismissal in the event of a flooding event which may inhibit access to a safe drop-off and pick-up area. The plans must be submitted to the Zoning Administrator for review and approval. (i) The establishment must be operated in compliance with any maximum occupancy load established by the Building Official. (j) Any construction on the subject property must be conducted in compliance with all applicable local, state, and federal codes, ordinances, and regulations. All required licenses and permits must be obtained and maintained as required until completion of the work. (k) All taxes/fees associated with the property must be paid when due, as determined by the city treasurer. (l) All local, state, and federal licenses and permits required for operation of the child day center must be obtained prior to commencement of the use and must be maintained in good standing for so long as the use continues.
