March 26, 2024 <br /> <br />IT BEING the same property conveyed to Printcraft Press, Inc. by Deed of Gift from Drew <br />F. Dixon and Carol Dixon dated May 7, 1996 and recorded in the Portsmouth Circuit Court <br />Clerkâs Office in Deed Book 1184 at Page 795. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The child day center shall comply with the use-specific standards set forth in <br />Section 40.2-217(E)(1) of the Zoning Ordinance. <br /> <br />(b) Where required by the Zoning Ordinance, all external site and building <br />improvements, including the proposed playground fencing, and any signage, must be <br />approved through issuance of a Certificate of Appropriateness (COA) by the Downtown <br />Design Committee (DDC) prior to the commencement of work. <br /> <br />(c) Prior to initially operating the approved use and so long as the use remains in <br />operation, the owners and/or operators shall install and maintain digital video equipment <br />with recording capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the front, side, <br />and rear exteriors of the establishment for 24 hours a day, 7 days a week. Recorded data <br />must be maintained in a condition permitting review of the information for a period of no <br />less than thirty days. <br /> <br />(d) Prior to any land disturbance on the subject property, a Site Plan must be <br />submitted to the Engineering Department for review and approval as and to the extent <br />required by the City Code. All excavation, land disturbance, and <br />construction/development activities on the property must be in full compliance with the <br />City Code. <br /> <br />(e) Prior to initially operating the approved use, a Zoning Permit from the City Zoning <br />Administrator and a Certificate of Occupancy (CO) from the Department of Permits and <br />Inspections must be obtained. <br /> <br />(f) Prior to initially operating the approved use, the operator must obtain permission <br />from the Engineering Department to utilize Guardian Court, or develop an alternative plan <br />that is approved by the Engineering Department, for the pickup and delivery of children <br />in a way that does not require children to have to cross vehicular travel ways to enter or <br />exit the center. <br /> <br />(g) The operator shall be required to install and pay the cost of any improvements <br />required to provide a designated safe drop-off and pick-up area. <br /> <br />(h) The operator must prepare plans for late opening and early dismissal in the event <br />of a flooding event which may inhibit access to a safe drop-off and pick-up area. The <br />plans must be submitted to the Zoning Administrator for review and approval. <br /> <br />(i) The establishment must be operated in compliance with any maximum occupancy <br />load established by the Building Official. <br /> <br />(j) Any construction on the subject property must be conducted in compliance with all <br />applicable local, state, and federal codes, ordinances, and regulations. All required <br />licenses and permits must be obtained and maintained as required until completion of the <br />work. <br /> <br />(k) All taxes/fees associated with the property must be paid when due, as determined <br />by the city treasurer. <br /> <br />(l) All local, state, and federal licenses and permits required for operation of the child <br />day center must be obtained prior to commencement of the use and must be maintained <br />in good standing for so long as the use continues. <br /> <br /> <br /> <br /> <br /> <br /> <br />
