<br />WHEREAS,
<br /> Printcraft Press, Inc., the owner of the subject property, has
<br />consented to the application; and
<br />
<br />WHEREAS
<br /> , the applicant and the Planning Director have done all things required
<br />to be done in connection with said application; and
<br />
<br />WHEREAS
<br /> , the Planning Commission has recommended the approval with
<br />conditions of the application for a use permit.
<br />
<br />NOW THEREFORE BE IT RESOLVED
<br /> by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That it has reviewed and considered the application materials, the City staff
<br />report, the proceedings and recommendation of the Planning Commission, all comments
<br />made at the public hearing, and the discussion of the Council regarding the application.
<br />
<br /> 2. That it has considered factors it deemed applicable and consistent with the
<br />Code of Virginia, which may include, without limitation, the nature, extent, external effects,
<br />location, design or method of operation of the requested use, the City’s comprehensive
<br />plan, and the public health, safety, and general welfare.
<br />
<br /> 3. That it has considered the imposition of conditions regarding the location,
<br />character, and other features of the proposed use and finds and determines that the
<br />conditions imposed by this Resolution are necessary to ensure compliance with the
<br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse
<br />effects from the proposed use.

<br /> 4. That based on its review and consideration, it has determined that the use
<br />GRANTED WITH CONDITIONS
<br />permit requested by the subject application should be
<br />as provided in this Resolution.
<br />
<br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the
<br />Code of the City of Portsmouth, Virginia to operate a child day center in an existing
<br />building at 309 Columbia Street (Tax Parcel 0007-0140), the said property being more
<br />particularly described as:

<br />ALL THAT certain tract, piece or parcel of land, situate in the City of Portsmouth, State of
<br />Virginia, with the appurtenances thereunto belonging, more particularly bounded and
<br />described as follows, to-wit: BEGINNING at a pin in the Southeastern corner of the
<br />intersection of Court and Columbia Streets; thence along the Southern right-of-way line
<br />of Columbia Street, North 87° 14’ 28” East 110.0 feet to a pin; thence along the line of
<br />Parcel 17, South 3° 27’ 52” East 115.72 feet to a pin; thence continuing along said parcel,
<br />South 46° 23’ 37” East 25.0 feet to a pin; thence along the periphery of a right-of-way cul-
<br />de-sac of 50 feet radius in a Southwesterly direction for an arc distance of 61.01 feet to a
<br />pin; thence along the line of Parcel 23, South 87° 14’ 28” West 115 feet to a pin; thence
<br />along the Eastern right-of-way line of Court Street, North 3° 27’ 52 West 190 feet to the
<br />pin at the point of beginning.

<br />The hereinabove described parcel is bounded on the North by Columbia Street, on the
<br />East by Parcel 17 and a right-of-way cul-de-sac, on the South by Parcel 23, and on the
<br />West by Court Street; contains 21,319 square feet, more or less; and is shown on a plat
<br />entitled ‘Physical Survey of Parcel 16 – Portsmouth Redevelopment and Housing
<br />Authority – Urban Renewal – Crawford Renewal Project VA R-53 – City of Portsmouth,
<br />Virginia’, dated March 21, 1971, prepared by R. Kenneth Weeks, Engineers, Norfolk,
<br />Virginia.
