March 26, 2024 <br /> <br />(d) The development shall be in substantial compliance, including with respect to <br />building design, construction materials, and concept exterior elevations, as shown in the <br />elevations submitted on January 12, 2024, except where modifications may be required <br />to comply with all applicable local, state, and federal codes and regulations, including City <br />Code Chapter 14.1 (Flood Protection). <br /> <br />(e) The development of the subject property shall not include more than three (3) <br />townhouses. <br /> <br />(f) The development shall be constructed in compliance with use-specific standards <br />for townhouse dwellings and multi-family dwellings in accordance with Zoning Ordinance <br />Sections 40.2-217(D)(1)(d) and (D)(1)(e). <br /> <br />(g) Prior to Site Plan Review approval, a minor subdivision plat to subdivide the <br />subject property into three (3) parcels for townhouses in accordance with Chapter 33.1 of <br />the City Code (Subdivisions) must be approved by the City and recorded in the Circuit <br />Court land records by the developer. <br /> <br />(h) The developer must submit a Site Plan to the Engineering Department for review <br />and approval. Without limitation, the Site Plan must comply with Chapter 31.2 of the City <br />Code (Stormwater Management). The Site Plan will be reviewed by the City to ensure <br />compliance with all applicable local, state, and federal codes and regulations. <br /> <br />(i) No trash cans shall be stored in the front or side yards of the development. <br /> <br />(j) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state, and local government, and all required <br />licenses and permits shall be obtained prior to construction and, as applicable, maintained <br />in effect during the operation of the development. <br /> <br />(k) All taxes/fees associated with the property shall be paid when due, as determined <br />by the City treasurer. <br /> <br />REVOCATION OF PERMIT <br />7. : Violation of any of the conditions set forth herein may <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />(b) UP-23-23 DOWNTOWN - Resolution granting the request of Tawana Frater, <br />with Gentle Touch Learning Center LLC, for a Use Permit to <br />operate a child day center on an approximately 0.49-acre parcel <br />located at 309 Columbia Street in the Downtown D1 T5 zoning sub- <br />district. The Future Land Use Map of the Build One Portsmouth <br />Comprehensive Plan designates this property for mixed-use <br />downtown. The property is owned by Printcraft Press Inc. <br />Planning Commission recommends approval with conditions. <br /> <br />1.
