<br /> Z-85-33 Rezoning application of Walter and Dorothy McDowell, by Michael K. Davis,
<br />for land on the north side of Bay Street from R-60 to Waterfront W-1. The applicant has
<br />indicated a desire to develop a marina and, if permissible, a dry storage facility.
<br />
<br /> Z-85-27 Rezoning application of David and Stephen Jordan for land on the north side
<br />of Bay Street from R-60 to Waterfront W-1. The applicants have indicated that they would
<br />expand the existing use as a storage marina for their ferry and tour boats and the future
<br />development of a restaurant.
<br />
<br /> CA-85-- A proposal to amend Section 40-81 of the City Code pertaining to permitted
<br />uses in the Waterfront W-1 District to permit ferry/tour boat marinas in the W-1 District
<br />upon the issuance of a use permit.

<br /> As you can see, three of the items relate to the Jordan proposal and the fourth to the
<br />DavisfZuraw proposal. It is my recommendation that the two rezoning requests be approved, and
<br />that the code amendment and use permit be denied.
<br />
<br /> The approval of the rezoning requests would allow for the development of the properties fc
<br />many of the proposed uses s~nce the W-1 Waterfront District permits commercial activities and
<br />recreational facilities which are peculiarly suited to a waterfront location including, but not
<br />limited to, pleasure craft marinas, restaurants, and hotels.
<br />
<br /> The City Attorney has advised that the proposed dry storage marina is not a permitted use
<br />under the current regulations governing the Waterfront W-1 District. In the absence of a code
<br />change, Messrs. Zuraw and Davis with the adoption of the rezoning, could develop a commercial
<br />marina without the dry storage facility.

<br /> The Jordan brothers currently berth their ferry/tour boats at their site, and
<br />continue to do so as a non-conforming use, however, I would respectfully suggest
<br />adoption of the amendment permitting such uses would not be conducive to the long
<br />ment of the area in question.

<br />ers in the neighborhood in order to establish a long range plan to maximize the potential for
<br />the respective sites in the Park View area.'

<br />Manager's recommendation, CA 85-7 was denied, and was adopted by the following vote:

<br />was objecting to a boat storage facility.
