January 14, 1986

85=374 Letter from the City Manager recommending adoption of a motion authorizing
the City Manager to excute a development agreement for the Truxtun School Site, deferred
from the regular meeting of November 26, 1985.

"At your meeting of November 26, 1985, you voted to defer action on the Truxtun School
Project's development agreement until your meeting of January 14, 1986. As you will recall,
it was anticipated that this action would provide an opportunity for the United Holy Church
of America, Inc., and the Charles Peete Little League to resolve those matters regarding the
ballfields. Additionally, this time period also would allow the Church to explore the avail-
ability for purchase of the adjacent parcel of land owned by the McLean Estate.

As of this writing, according to staff reports, it does not appear that the Church and
the Little League have come to common agreement re~arding the ballfields. It does appear,
however, according to the representatives of the United Holy Church of America that they may
be able to purchase the property from the McLean Estate, even though to date no contract has
been signed.

In view of the fact that the Church and the Little League representatives have been
unable to come to terms regarding the ballfields, and additionally, since this matter has been
deferred on a number of occasions, I recommend that this matter be tabled until such time that
the principals have been able to come to common agreement."

Lucy Overton, 36 Hobson Street, representing Old Truxtun Community League, spoke in
support of the townhouses and inquired for the delay of the development.

Dr. William H. Harris, 3517 Portsmouth Boulevard, representing Charles Peete Littl
League, requested an additional 3 minutes.

Motion of Mrs. Webb and s,econded by Mrs. Lucas, Dr. Harris was granted his request,
was adopted by 6-0-1(Abstaining-Corprew)

and

Councilman Corprew stated that he abstained because the speaker was a relative.

Dr. Harris spoke concerning the ballfields and requested appropriate play area for the
children.

J. T. Davis, $807 Sumer Drive, Virginia Beach, VA, representing United Holy Church of
America, asked for direction as to what is expected of him to develop the property.

Henry L. Marsh, III, 509 N. Third Street, Richmond, VA, attorney representing the
VA District Convocation United Holy Church of 'America, stated that the Church is willing
to set aside the property for the h~llfields as requested.

Motion of Mrs. Webb and seconded by Mr. Whitlow, to suspend the rules for Dr. Harris to
speak for 2 minutes, and was adopted by 6-0-1 iAbstaining-Corprew).

Dr. Harris, stated letter from Bishop Talley dated 12/24/85, long after Mr. Brown's
death, did not reflect a proper proposal for the ~ll£ields. And asked that some thought be
gmven about the play area for the children in the area.

Motion of Mr. Whitlow and seconded by Mrs. Webb, to concur with the City Manager's
that the matter be tabled until such time the parties are able to reach an agreement and
was defeated by the following vote:

Ayes: Gray, Webh, Whitlow
Nays: Beamer, Holley, Lucas
Abstaining: Corprew

Motion of Mrs. Webb and seconded by Mr. Whitlow, to defer to matter to the first meeting
in May.

Motion was withdrawn with the consent of Mr. Whitlow, who seconded.

Motion of Mrs. Lucas and seconded by Mrs. Webb, to
speak for 5 minutes.

Bishop Talley, stated that he felt that the matter
within 30 days.

suspend the rules for Bishop Talley tc
could be resolved and plans completed

Motion of Mrs. Lucas and seconded by Mr. Gray te defer the matter to
in February (Feb 11, 1986j, and was adopted by 6-0-1 (Abstaining-Corprew).

Motion of Mr. Whitlow and seconded by Mrs. Webb, Council recessed at
by unanimous vote. 6Council recessed before Item 85-374 was presented)

Council reconvened at 9:21 p.m.

the first meeting

9:15p:m., was adopted

85-261 Rezoning applicanion, and amendment to the City Code:

The following letter was submitted by the City Manager concerning the following izems,
85-261 (c) & (d), 85-241 (a), 85-340 (e):

Deferred from your meeting of November 12, 1985 were four
of property in the Park View Community.
