<br /> 85=374 Letter from the City Manager recommending adoption of a motion authorizing
<br />the City Manager to excute a development agreement for the Truxtun School Site, deferred
<br />from the regular meeting of November 26, 1985.
<br />
<br /> "At your meeting of November 26, 1985, you voted to defer action on the Truxtun School
<br />Project's development agreement until your meeting of January 14, 1986. As you will recall,
<br />it was anticipated that this action would provide an opportunity for the United Holy Church
<br />of America, Inc., and the Charles Peete Little League to resolve those matters regarding the
<br />ballfields. Additionally, this time period also would allow the Church to explore the avail-
<br />ability for purchase of the adjacent parcel of land owned by the McLean Estate.
<br />
<br /> As of this writing, according to staff reports, it does not appear that the Church and
<br />the Little League have come to common agreement re~arding the ballfields. It does appear,
<br />however, according to the representatives of the United Holy Church of America that they may
<br />be able to purchase the property from the McLean Estate, even though to date no contract has
<br />been signed.
<br />
<br /> In view of the fact that the Church and the Little League representatives have been
<br />unable to come to terms regarding the ballfields, and additionally, since this matter has been
<br />deferred on a number of occasions, I recommend that this matter be tabled until such time that
<br />the principals have been able to come to common agreement."
<br />
<br /> Lucy Overton, 36 Hobson Street, representing Old Truxtun Community League, spoke in
<br />support of the townhouses and inquired for the delay of the development.
<br />
<br /> Dr. William H. Harris, 3517 Portsmouth Boulevard, representing Charles Peete Littl
<br />League, requested an additional 3 minutes.
<br />
<br /> Motion of Mrs. Webb and s,econded by Mrs. Lucas, Dr. Harris was granted his request,
<br />was adopted by 6-0-1(Abstaining-Corprew)
<br />
<br />and

<br />Councilman Corprew stated that he abstained because the speaker was a relative.
<br />
<br /> Dr. Harris spoke concerning the ballfields and requested appropriate play area for the
<br />children.
<br />
<br /> J. T. Davis, $807 Sumer Drive, Virginia Beach, VA, representing United Holy Church of
<br />America, asked for direction as to what is expected of him to develop the property.
<br />
<br /> Henry L. Marsh, III, 509 N. Third Street, Richmond, VA, attorney representing the
<br />VA District Convocation United Holy Church of 'America, stated that the Church is willing
<br />to set aside the property for the h~llfields as requested.
<br />
<br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, to suspend the rules for Dr. Harris to
<br />speak for 2 minutes, and was adopted by 6-0-1 iAbstaining-Corprew).
<br />
<br /> Dr. Harris, stated letter from Bishop Talley dated 12/24/85, long after Mr. Brown's
<br />death, did not reflect a proper proposal for the ~ll£ields. And asked that some thought be
<br />gmven about the play area for the children in the area.
<br />
<br /> Motion of Mr. Whitlow and seconded by Mrs. Webb, to concur with the City Manager's
<br />that the matter be tabled until such time the parties are able to reach an agreement and
<br />was defeated by the following vote:

<br />Ayes: Gray, Webh, Whitlow
<br />Nays: Beamer, Holley, Lucas
<br />Abstaining: Corprew
<br />
<br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, to defer to matter to the first meeting
<br />in May.
<br />
<br />Motion was withdrawn with the consent of Mr. Whitlow, who seconded.

<br />speak for 5 minutes.
