January 14, 1986 <br /> <br />"A RESCLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING <br />KNOWN AS "BILTMORE COMMONS PLACE" AND DESIGNATED AS GHP-8S-30. <br /> <br /> WHEREAS, C. Raef>rd Eure, has made application pursuant to ~40-55 of the Code of the City <br />of Portsmouth, Virginia, 1973, for the granting and approval of a group housing project con- <br />sisting of one hundred eight (1081 condominium units on approximately 4.9 acres of property <br />located on the south side of Elliott Avenue between Frederick and Deep Creek Boulevards; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of 640-55; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended conditional approval of said application, which conditicns <br />included the elimination of the three buildings on the eastern border and the establishment of <br />open space to be used for recreatinal purFoses; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuanl <br />to §40-55 grants only an exemption from certain requirements for residences as stated in said <br />seztion and does not constitute a waiver of any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or an)- other applicable <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or any other required permit will <br />be issued only upon compliance with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain group housing project known as "Biltmore Commons Place" to be constructed on <br />approximately 4.9 acres of property located on the south side of Elliott Avenue between <br />Frederick and Deep Creek Boulevards (Tax Map 473, Parcel 51 and designated as GMP-85-30 is <br />hereby granted approval subject to the following terms and conditions: <br /> <br /> 1. The site plan to be made a part hereof is to be revised so as to provide a maximum <br />density of sixteen (161 units per acre, such revised site plan to be submitted to the <br />Engineering fi Technical Services Department EoT review and approval and same must address <br />stabilization of the topography in the rear yard and the bank of Paradise Creek. <br /> <br /> 2. Recreational facilities must be reviewed and approved by the Planning Staff prior <br />to issuance of building permits. <br /> <br /> 3. No occupancy permits should be issued until landscaping, including the proposed <br />berm, as shown on submitted plans ins properly installed. <br /> <br /> 4. Location 6f the dumsters must be approved by the Department of Public Works during <br />detailed site plan review." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-390 The following ordinance approved on first reading at the regular meeting of <br />December 10, 1985, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $15,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />REPAIR AND REPLACEMENT OF FURNITURE AT THE CITY LIBRARY (COURT STREETi " <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Gray, the ordinance was adopted on final <br />reading, and by the following vote: <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-391 The following ordinance approved on first reading at the regular meeting of <br />December 10, 1985, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $130,000 FROM THE CAPITA1 IMPROVEMENT FUND FOR <br />ENGINEERING AND SURVEY I~ORK ON PROJECTS PROVIDED FOR IN THE 1985-86 CAPITAL <br />IMPROVEMENT PLAN." <br /> <br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the ordinance was adopted on final <br />reading, and by the following vote: <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 85-392 The following ordinance approved on first reading at the regular meeting of <br />December 10, 1985, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $50,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />IMPROVEMENTS AT SLEEPY HOLE PARK.~ <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Gray, the ordinance was adopted on final <br />reading, and by the following vote: <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley <br /> <br />Nays: None <br /> <br /> <br />
