<br /> (a) The use permit shall be issued for a two year trial period from date of its
<br />adoption and any request for an extension of time must be supported by findings such as would
<br />be recuired if the use permit was being requested for the first time.
<br />
<br /> (b) All outdoor play activities shall be conducted within a ~enced play area and
<br />between the hours of 8:00 a.m. and 6:00 p.m.
<br />
<br /> (c) The applicant shall submit a site plan outlining the required fourteen (14)
<br />on-site parking spaces within the designated parcel with planting screen subject to Planning
<br />Staff approval.
<br />
<br /> (d) The applicant shall comply with all applicable codes, ordinances, policies and
<br />regulations of federal, state and local governments and shall obtain all necessary licenses
<br />and permits.
<br />
<br /> (e) All health, fire and building codes must be met prior to commencement of
<br />operation of this facility.
<br />
<br /> (f) This use permit is issued to the Portsmouth Area Reseurces Coalition, Inc. for
<br />the Dale Homes Recreation Center and surrounding designated area au 1900 Columbus Avenue and
<br />is not transferable to any other person, entity or location."

<br />UP 85-28 TRUXTUN NEIGHBORHOOD: Use permit application of HOP-In, Inc., by
<br />Gas Agent Ray Hope, for.gas pumps at 2330 Portsmouth Boulevard, approved
<br />Station on first reading at the Public Hearing of December 10, 1985, was
<br /> taken up and read.
<br />
<br /> Jim Tinkham, 1120 Independence Boulevard, Virginia Beach, representing HOP-In Food Store
<br />Inc., stated that he was only requesting gas pumps.
<br />
<br /> On motion of Mr. Whitlow and seconded by ~r. Gray, the £ollowing resolution was adopted
<br />on final reading, and by the following vote:
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO HOP-IN, INC. TO OPERATE GASCLINE PUMPS
<br />IN CONJUNCTION WITH A CONVENIENCE STORE AT 2330 PORTSMOUTH BOULEVARD.
<br />
<br /> WHEREAS, Hop-In, Inc., by Ray Hope, Agent, has made application pursuant to 940-102 (I)
<br />(1) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit
<br />as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit hereinafter-described is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will no~ be detrimental to the public use or injurious to the property or
<br />improvements of the neighborhood; and
<br />
<br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. Hop-In, inc. is hereby granted a use permit pursuant to ~40'-I02 (I) (1) of the
<br />Code of-the City of Portsmouth, Virginia, 1973, to operate gasoline pumps ~n conjunction with
<br />a convenience store on property located at 2330 Portsmouth Boulevard [Tax Map 200, Parcel 1)
<br />such site consisting of approximately 41,600 square feet or 0.95 acres.
<br />
<br />3. This use permit is approved subject to the following conditions:
<br />
<br /> (a) A standard site improvement plan must be submitted to the Department of Enginee~
<br />in & Technical Services for review and approval.'
<br />

<br />of C. Rae£ord Eure, Owner-Developer, for condominium units on the
<br />south side of Elliott Avenue between Frederick and Deeo Creek Boule-
<br />vards, approved on first reading at the Public Hearing of December
<br />10, 1985, was taken up and read.
<br />
<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted on
<br />final reading, and by the following vote:
