September 26, 2023 <br /> <br />“ORDINANCE TO AMEND AND REORDAIN ARTICLE I OF CHAPTER 32 (STREETS, <br />SIDEWALKS AND LOCAL IMPROVEMENTS) OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA BY ADDING A NEW SECTION 32-31 REGARDING <br />VISIBILITY CLEARANCE AT INTERSECTIONS.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />23 - 301 - Adoption of an ordinance to substantially amend and reordain Chapter <br />39 (Wetlands) of the Code of the City of Portsmouth, Virginia to comply with Section <br />28.2-1302 of the Code of Virginia, which requires that certain amendments be <br />adopted no later than January 1, 2024, and to make certain additional <br />administrative modifications to the text of the Chapter. <br /> <br />Background: <br /> <br /> In 2023 the Virginia General Assembly adopted SB 1160, which made certain <br />modifications to the state’s wetlands requirements and required that localities amend their <br />local Wetlands Zoning Ordinances to conform to the requirements set out by the state in <br />Chapter 13, Article 2 of Title 28.2 of the Virginia Code. <br /> <br /> Localities are required to adopt the amendments by January 1, 2024. <br /> <br />Discussion: <br /> <br /> <br /> The City’s Wetlands Ordinance is set out in Chapter 39 of the City Code. <br /> <br /> The proposed ordinance amends the Wetlands Ordinance to comply with the <br /> <br />requirements of the Virginia Code. <br /> <br />Financial Impact: <br /> <br /> <br /> None. <br /> <br />Recommended Action: <br /> <br /> <br /> <br /> Adoption of the ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> The Planning Department and Wetlands Board will implement the revised <br /> <br />ordinance. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Barnes, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO SUBSTANTIALLY AMEND AND REORDAIN CHAPTER 39 <br />(WETLANDS) OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA TO <br />COMPLY WITH SECTION 28.2-1302 OF THE CODE OF VIRGINIA, WHICH REQUIRES <br />THAT CERTAIN AMENDMENTS BE ADOPTED NO LATER THAN JANUARY 1, 2024, <br />AND TO MAKE CERTAIN ADDITIONAL ADMINISTRATIVE MODIFICATIONS TO THE <br />TEXT OF THE CHAPTER.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />23 - 302 - Adoption of an ordinance accepting a grant in the amount of $25,990 from <br />the National Highway Traffic Safety Administration through the Virginia Highway <br />Safety Office and appropriating said funds in the FY 2024 Grants Fund for use by <br />the Police Department for Traffic Safety Initiatives. <br /> <br />Background: <br /> <br /> The Portsmouth Police Department has been awarded grant funding in the amount <br />of $25,990 from the US Department of Transportation (DOT) National Highway Traffic <br />Safety Administration (NHTSA) through the Virginia Highway Safety Office (VHSO). <br /> <br /> Estimated revenue in the FY 2024 Grants Fund is increased by $25,990. <br /> <br /> <br /> <br /> <br /> <br /> <br />
